EFFECTIVE DATE OF SETTLEMENT. 38. The Effective Date of this Settlement shall be the first business day on which all of the following shall have occurred or been waived:

Settlements reached at any step of the grievance procedure may be applied retroactively to the date of the occurrence of the situation which gave rise to the grievance or the settlement may be applied in a different manner which is consistent with the intent of Clause 74.12.
EFFECTIVE DATE OF SETTLEMENT. (a) The Effective Date of Settlement shall be the date when all of the following events shall have occurred and shall be conditioned on the occurrence of all of the following events:

EFFECTIVE DATE OF SETTLEMENT. 4.1. The Effective Date of Settlement shall be the date when all of the following events shall have occurred and shall be conditioned on the occurrence of all of the following events: (i) payment by RBS to the Settlement Fund of the amount required by this Agreement; (ii) entry of the Preliminary Approval Order; (iii) final approval by the Court of the Settlement, following Class Notice and the Fairness Hearing; and (iv) entry by the Court of a Judgment, and the Judgment becomes Final, or, in the event that the Court enters an Alternative Judgment and neither Bond- holder Plaintiffs nor RBS elects to terminate this Agreement, and such Alternative Judgment be- comes Final, provided that no Party has exercised his, her, or its rights to terminate this Agreement pursuant to paragraph 10 below.
EFFECTIVE DATE OF SETTLEMENT. The Settlement shall be effective on the first date after all of the following events have occurred: (1) entry of the Preliminary Approval Order substantially in the form submitted by the parties, or entry of a preliminary approval order not substantially in the form submitted by the parties, with respect to which neither GE nor Settlement Class Counsel invoke their termination rights within the period prescribed in Paragraph 54 of this Agreement; (2) final approval by the Settlement Court of this Agreement, following notice to the Class and a Final Approval Hearing, as prescribed by Fed. R. Civ. P. 23(e); (3) entry by the Settlement Court of an Order and Final Judgment, in a form not materially inconsistent with this Agreement; and (4) if any Settlement Class Member files an objection to the Settlement, the expiration of any time for appeal or review (including by writ of certiorari or otherwise) of such Order and Final Judgment, or, if any appeal is filed, after such Order and Final Judgment is upheld on appeal in all material respects and is no longer subject to review on appeal or review by writ of certiorari.
EFFECTIVE DATE OF SETTLEMENT. The Seller and the Buyer hereby acknowledge and agree that the terms of conditions of the settlement set forth in Section 1 of this Agreement will not be effective until such time as the Buyer, the Seller and SUSA have each executed and delivered that certain Consent and Confirmation attached as Exhibit G to the Amendment to the PSA dated December 22, 2014 between the Seller and the Buyer (the “Consent”). Upon the date of execution and delivery of the Consent (the “Effective Date”) by the Buyer, the Seller and SUSA, this Agreement and all of the terms and conditions set forth herein shall be effective and binding upon the Parties as of the Effective Date including, without limitation, the Seller’s waiver and release of any Title Benefits and agreement to adjust the Purchase Price under subparts (a) and (b) of Section 1 hereof and the waivers and releases of the Buyer under subparts (i), (ii), (iii), (iv) and (v) of Section 1 hereof.
EFFECTIVE DATE OF SETTLEMENT. 7 The Settlement becomes effective as of April 30, 2003 (“Effective Date”).
