Duty of Care and Exercise of Authority. 3.3.1 Notwithstanding anything else in this Agreement or any legal requirement of the Country or any other jurisdiction (including, for the avoidance of doubt, the jurisdiction of the place of establishment of the Consultant), the Consultant shall carry out his obligations as set forth in this Agreement.

Duty of Care and Exercise of Authority. 4.1The Independent Engineer warrants to the Authority and the Concessionaire that in respect of the Services it has exercised and will continue to exercise all reasonable skill, care and diligence to be expected of a properly qualified professional engineer who has held itself out as suitable and competent to perform the Services and who is experienced in providing services similar to the Services in relation to projects of a similar size, scope, nature and complexity to the Project.

Any review or approval by the Owner or any of its advisors or Architects of any reports, plans, drawings, specifications, designs or recommendations made by the Architect shall not absolve the Architect of any of his obligations under this provision.
