Disposal of Information. 17.1 The Contractor shall not retain any information acquired or generated under this Contract beyond the termination or expiry of this Contract.

Disposal of Information. The Parties agree that at the termination of this Operating Agreement, unless renewed pursuant to La. R.S. § 17:3992, Charter Operator shall provide all relevant data to OPSB in a usable electronic form, and erase, destroy, and render unreadable all remaining personally identifiable data in its entirety in a manner that prevents its physical reconstruction through the use of commonly available file restoration utilities, and certify in writing that these actions have been completed within 30 (thirty) days of the termination of this Agreement.

If information is printed off of an electronic system, it will be disposed of through a RESTRICTED waste system, using a shredder, or will be returned to MPS premises for disposal. Electronic information will be disposed of by being overwritten using an approved software utility or through the physical destruction of the computer media. Data held electronically shall be weeded according to each agencies standard operating procedure in relation to their IT systems. Community MARAC panel members will ensure that all papers are destroyed once details are entered on their agencies database(s), restricting unauthorised access.

Information will be stored in accordance with the operational need of the requesting organisation’s operational need and subject to the archiving policy of the supplying organisation. Storage and disposal rules will be agreed between the supplier and the requesting organisations.

Disposal of Information. Upon termination of this Agreement or upon the disclosing Party’s request at any time, the receiving Party agrees to promptly return to the disclosing Party all copies of Information. If return is impossible as to any portion of the Information, then the receiving Party shall certify to the disclosing Party promptly that all such Information of the disclosing Party, including all copies thereof, has been totally and permanently destroyed, provided however, that Company shall not be required to destroy electronic archives, files, and backups that contain Information (and such Information that is not destroyed shall remain subject to the terms of this Agreement).
Disposal of Information. 2.12The Data Recipient shall ensure adequate back-up facilities to minimise the risk of loss of or damage to Information supplied under this Agreement and that a robust business continuity plan is in place in the event of restriction of service for any reason.
