Disposal of Information. Upon termination of this Agreement or upon the disclosing Party’s request at any time, the receiving Party agrees to promptly return to the disclosing Party all copies of Information. If return is impossible as to any portion of the Information, then the receiving Party shall certify to the disclosing Party promptly that all such Information of the disclosing Party, including all copies thereof, has been totally and permanently destroyed, provided however, that Company shall not be required to destroy electronic archives, files, and backups that contain Information (and such Information that is not destroyed shall remain subject to the terms of this Agreement).
Disposal of Information. 2.12The Data Recipient shall ensure adequate back-up facilities to minimise the risk of loss of or damage to Information supplied under this Agreement and that a robust business continuity plan is in place in the event of restriction of service for any reason.
