Pursuant to La. R.S. 30:127(G), Operator shall maintain and preserve the public’s access to public waterways throughout the Property covered by this Agreement; (b) Subject to the provisions of La. R.S. 30:127(G), Operator is permitted to enclose (including by way of fencing) and protect the Injection well site portions of the Facilities or other portions of the surface Facilities as may be necessary for safety purposes;
Pursuant to La. R.S. 30:127(G), AP shall maintain and preserve the public’s access to public waterways throughout the Property covered by this Agreement; (b) Subject to the provisions of La. R.S. 30:127(G), AP is permitted to enclose (including by way of fencing) and protect the Injection well site portions of the Facilities or other portions of the surface Facilities as may be required by applicable Sequestration Protocols; (c) AP shall grant the State, or any other person or entity acting on behalf of the State, access at all reasonable times via any road or waterway to inspect the Property to ensure compliance with all requirements of this Agreement or to exercise any right reserved explicitly or impliedly in this Agreement; and (d) the State retains the right to sell, exchange, transfer, or otherwise dispose of all or any portion of the Property and all rights in the Property not expressly granted to AP or necessarily implied by this Agreement. Further, the State shall have the right to use any and all portions of the Property for any purpose or to issue rights-of-ways and servitudes upon the Property, provided doing so does not unreasonably interfere with the rights of AP. For the avoidance of doubt, DWF retains the right to access the Properties to carry out its statutory duties, authorities, and programs, subject to AP’s rights under this Agreement.
Pursuant to La. R.S. 24:175, the provisions of the Securitization Act are severable, such that if any provision or item of the Securitization Act, or the application thereof, is held invalid by any court of competent jurisdiction, the invalidity will not affect any other provision or item or the applications of the statute which can be given effect without the invalid provision, item, or application.
Pursuant to La. R.S. 9:2778, the AGREEMENT and its enforcement shall be governed by the laws of the State of Louisiana, without reference to conflict of law provisions that may refer the resolution of such dispute to laws of another state for decision.
Pursuant to La. R.S. 30:127(G), Capio shall maintain and preserve the public’s access to public waterways throughout the Property covered by this Agreement;
Pursuant to La. R.S. § 17:3914(F)(1), this Agreement shall be considered a contract between the Charter Operator and OPSB for student and education services, including, but not limited to educational and related services provided by the Charter School and citywide and oversight services provided by OPSB. Accordingly, Charter School and OPSB agree to share student information for such purposes. The Parties’ use and possession of student data is in accordance with La. R.S. § 17:3914(F)(1). The Parties shall each comply with all federal, state, and local laws and policies related to ensuring the privacy, security, and confidentiality of such student data, including but not limited to the Family Educational Rights and Privacy Act (FERPA), 20 U.S.C.A. 1232g, and La. R.S. §§ 17:3913 and 17:3914.
Pursuant to La. R.S. § 17:3992(C), OPSB may revoke the Charter at any time, in accordance with La. R.S. § 17:10.7.1 and the procedures set forth in OPSB Policy HB upon a determination that Charter School or its board members, officers or employees did any of the following in connection with the operation of Charter School:
Pursuant to La. R.S. § 17:3993, OPSB shall not be liable for Charter School’s unpaid debts.
Pursuant to La. R.S. 9:2778, the parties stipulate that the venue of any possible litigation arising pursuant to this AGREEMENT shall be in the United States District Court for the Western District of Louisiana, Shreveport Division.
Pursuant to La. R.S. § 17:10.7.1, OPSB has authority to monitor and require corrective actions by Charter School, in accordance with state law and OPSB Policy Section HB.
