Construction of the Development. Undertake the Development The Lessor must at its cost carry out and complete the Development in accordance with this clause 4. The Lessor must commence construction of the Development before the Development Commencement Date. The Lessor must carry out the Development diligently, effectively and in a proper and workmanlike manner: in accordance with: the Design Documents; the NT Planning Scheme; the requirements of and to the satisfaction of any relevant Authority; and all applicable Laws; using materials, finishes and fixtures that are durable, hard–wearing and low maintenance which are fit for their intended purpose; to complete each Dwelling by the relevant Date for Practical Completion, subject to any extensions of time to the relevant Date for Practical Completion as provided for in this Agreement; under adequate and competent supervision; in accordance with the Requirements; and in accordance with Good Operating Practices. The Lessor must ensure the Development complies with relevant building codes and standards, including: the Building Code of Australia; any relevant Australian Standards; the Building Act (NT) and Building Regulations; NT Deemed to Comply Manual (Building Advisory Committee); and any other applicable Laws. The Lessor is responsible for the Development and for ensuring that it complies with this Agreement, and will not be relieved of that responsibility because of any: involvement by the Lessee in the performance of this Agreement; or subcontracting by the Lessor of any part of this Agreement or any obligations under it.
