CONSTRUCTION OF THE PROJECT/APARTMENT. The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the [Apartment/Plot] and accepted the floor plan, payment plan and the specifications, amenities and facilities [annexed along with this Agreement] which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent Authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the [Please insert the relevant State laws]and shall not have an option to make any variation /alteration / modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of the Agreement.
CONSTRUCTION OF THE PROJECT/APARTMENT. 7.1 The Promoter has disclosed the Floor Area Ratio (FAR) proposed to be utilized by him on the Project and Allottee has agreed to purchase the Apartment based on the proposed construction and sale of apartments to be carried out by the Promoter by utilizing the proposed FAR and on the understanding that the declared proposed FAR shall belong to the Promoter only. If any FAR remains unutilized in the Project, the Promoter will be at liberty to consume the same at its discretion. Subject to the terms that the Promoter undertakes to strictly abide by such plans approved by the competent authorities and shall also strictly abide by the bye-laws, FAR and density norms and provisions prescribed by the Act and shall not have an option to make any variation / alteration / modification in this Project except rise in the floors, that too if possible before giving possession to the Allottee and also within scheduled time of delivery.
CONSTRUCTION OF THE PROJECT/APARTMENT. The Purchasers have seen, inspected and accepted the said Apartment, the completion certificate/ occupancy certificate and also the floor plan as also shown in Annexure-A and also the specifications, amenities and facilities of the Apartment/Project as mentioned in the Part II of the THIRD SCHEDULE hereto and have accepted the same which has been approved by the competent authority.

The Vendor shall be entitled to acquire any contiguous or adjacent lands to the present project, in which event such acquired land will be amalgamated / joined / added with the existing land contained in the project at the discretion of the Vendor/ Developer and thereafter, the Vendor/ Developer shall be entitled to construct other building or buildings on such acquired land and the owners of the Apartment of such Buildings will also be entitled to the benefits of all the internal roads, driveways, passages, green areas, facilities, utilities and Common Portions of the Project and the Purchaser and the purchasers of the other flats in the existing project shall be deemed to have consented to the same. The Owner and the Developer can make addition of the said project by way of (1) integrating/adding (notionally or actually) adjacent/other lands and premises (collectively Other Property) to the Said Project, (2) extending, modifying and realigning the extent, area, layout and location of the Said Project including the Common Portions thereof, (3) modifying the Sanctioned Plans (excluding the portion relating to the Said Flat), if necessary and (4) granting all forms of unfettered and perpetual proportionate right of ownership, use and easement over the Common Portions of the Said Project and the Said Premises to other intending buyers of Other Property (collectively Other Property Owners) as per prescribed norms of HIRA. CONSTRUCTION OF THE PROJECT/APARTMENT. The Purchaser has seen the Project and the Designated Apartment and all Common Areas thereat including all facilities, amenities and specifications thereat and the quality of materials and workmanship used therein and is fully satisfied thereabout. The Purchaser has also seen the layout plan, and the sanctioned plans as modified and verified the same with the Designated Apartment and the Project including as regards the area, the facilities, amenities and specifications thereat.

The Promoter assures to hand over possession of the [Apartment/Plot] along with ready and complete common areas with all specifications, amenities and facilities of the project in place on _________________, unless there is delay or failure due to war, flood, drought, fire, cyclone, earthquake or any other calamity caused by nature affecting the regular development of the real estate project (“Force Majeure”). If, however, the completion of the Project is delayed due to the Force Majeure conditions then the Allottee agrees that the Promoter shall be entitled to the extension of time for delivery of possession of the [Apartment/Plot], provided that such Force Majeure conditions are not of a nature which make it impossible for the contract to be implemented. The Allottee agrees and confirms that, in the event it becomes impossible for the Promoter to implement the project due to Force Majeure conditions, then this allotment shall stand terminated and the Promoter shall refund to the Allottee the entire amount received by the Promoter from the allotment within 60 days from that date. The Owner/Developer shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities, subject however to such minor architectural or structural changes as may be advised by the Project Architect(s) or project consultants and/or the competent sanctioning authority in accordance with the applicable laws.
