Comparable Treatment. Notwithstanding any other provision of this Section, no Lender shall demand compensation for any increased cost or reduction pursuant to this Section if such Lender is not demanding such compensation in similar circumstances under comparable provisions of other credit agreements.
Comparable Treatment subject to section 1.1.6 of this Schedule 1, in the provision of Deliverables at BRI Return Locations as contemplated in this section 1.1.1 of this Schedule 1, BRI agrees that consumers returning empty Program Containers will receive the same level of customer service BRI provides to consumers returning empty BRI Beer Containers at BRI Return Locations.
Comparable Treatment subject to section 1.1.6 of this Schedule 1, in the provision of Deliverables to Licensees as contemplated in this section 1.1.2 of this Schedule 1, BRI agrees that Licensees returning empty Program Containers will receive the same level of customer service BRI provides to Licensees returning empty BRI Beer Containers, including that BRI will adopt its dispute resolution process that exists with respect to the BRI Beer Container Recovery System regarding Licensees to address any complaints that affect such Licensees in connection with BRI’s obligations under this Contract.
Comparable Treatment subject to section 1.1.6 of this Schedule 1, in the provision of Deliverables to EBDs as contemplated in this section 1.1.3 of this Schedule 1, BRI agrees that EBDs returning empty Program Containers will receive the same level of customer service BRI provides to EBDs returning empty BRI Beer Containers, including that BRI will adopt its dispute resolution process that exists with respect to the BRI Beer Container Recovery System regarding EBDs to address any complaints that affect such EBDs in connection with BRI’s obligations under this Contract.
Comparable Treatment subject to section 1.1.6 of this Schedule l, in the provision of Deliverables to Agency Stores as contemplated in this section 1.1.4 of this Schedule 1, BRI agrees that Agency Stores returning empty Program Containers will receive the same level of customer service BRI provides to Agency Stores returning empty BRI Beer Containers, including that BRI will adopt its dispute resolution process that exists with respect to the BRI Beer Container Recovery System regarding Agency Stores to address any complaints that affect such Agency Stores in connection with BRI’s obligations under this Contract.
Comparable Treatment. Notwithstanding any other provision in this Clause 16, the Bank shall not demand compensation from the Applicant for any Increased Costs if the Bank is not demanding such Increased Costs in similar circumstances under comparable provisions of other credit agreements.
Comparable Treatment. Iraq commits to seek from all its other similarly-situated external creditors debt reduction and repayment arrangements on terms that are no less favorable to Iraq than those set forth in the Minute.
Comparable Treatment. The Executive and, as applicable, his family shall be entitled to material terms of his employment, including without limitation compensation, employee benefits, life insurance, health, medical, hospitalization, dental and prescription drug benefits, and travel accident insurance, and fringe benefits and perquisites in accordance with the most favorable terms, benefits, plans, practices, programs and policies of the Company (on the most favorable terms and conditions) in effect for its senior executives from time to time, which, in any event, shall not be less favorable than those in effect on the Commencement Date.
Comparable Treatment. Except as is otherwise expressly set forth in this Agreement and other than differences with respect to the amount of the respective Commitments of each Investor, the terms of all of the Equity Commitment Letters are on substantially similar terms to the other Equity Commitment Letters, the terms of all of the Contribution Agreements are on substantially similar terms to the other Contribution Agreements, and all side agreements or letters pertaining thereto (if any) have been provided to Spectrum and all Co-Investors. Except as is otherwise expressly set forth in this Agreement or in Exhibit B, in the event that the Permira Funds or Parent grant any rights (including by means of any waiver of restrictions) with respect to the transfer of securities in Parent, the participation in tag-along sales, preemptive rights, registration rights, information rights, director designation, committee designation, observer designation, or Investor approval rights or other governance or economic rights to or for the benefit of any Investor (other than the Permira Funds) that are more favorable than the rights granted to any other Investor (other than the Permira Funds) pursuant to the agreements contemplated hereby, (a) such other Investors shall be entitled to all such rights (or such waivers of restrictions) as well, (b) the Permira Funds and Parent shall cause the applicable agreements contemplated hereby to be amended as necessary to give effect to the foregoing, and (c) each of the parties hereto hereby consents to any such amendment. For the avoidance of doubt, the foregoing rights to comparable treatment shall not apply to or affect any differences in treatment among the Investors expressly set forth herein or Exhibit B.
Comparable Treatment. Section 1. During the term of this Agreement, if any other collective bargaining unit within the City (FOP, IAFF, or TEAMSTERS) receives a higher general wage increase or better health and life insurance benefits than employees covered under this Agreement, then the employees covered under this Agreement shall receive the same wage increase or the same health and life insurance benefits as received by the other collective bargaining units.
