ALBUMS. Boxcar’s albums (“Albums”) are the sole property of Boxcar and are loaned to Reseller subject to the Reseller’s compliance with the terms and conditions of this Agreement. Albums may not be copied or otherwise reproduced in whole or in part. Albums may be used only within the Territory. Reseller may not use Albums in any other location, including any other retail location owned by Reseller, or transfer Albums to any other person or entity, without Boxcar’s prior written consent. Any attempted transfer in violation of the foregoing is void.

ALBUMS. In order to add content to the Storyboard/Timeline, you need to first create an album. Albums consist of shortcuts that link to files stored on your computer. If you can master this concept (and it isn't that difficult, trust us), you're way ahead of the game. Think of album content in the same light as shortcuts on your desktop or taskbar. The icons that you click aren't the actual program icons; they're merely shortcuts. It's the same with albums. Albums contain shortcuts to your pictures, music, and videos. There are a few sample albums included. You can create multiple albums, giving each one a unique name. For example, you can have one album for vacation photos, another one for family events... you get the idea. Obviously, you need to know the location of the photos, videos, and sounds that you want to include in your album. To create a new album:

ALBUMS. All images required for the album must be advised to the photographic studio (Individual Photography) with 3 months of the date of the final photo shoot, unless Individual Photography has been authorised to choose the images. Failure to do so could result in increased costs for the manufacture of the album. Any such costs after 3 months will be passed on to the client. The photographer will supply the album and number of pages that has been ordered subject to any variations that the client may make. Any variations over and above that originally order by the client will be charged at the rate current at the time of commission, and will be included in the final account. The photographer agrees to allow 6 hours for the creation of the album with and will include up to two sets of design changes. Any increase on this allowance will be charged at the hourly rate in force at the time of the commission.
ALBUMS. If an album is included in Clients’ Services or subsequently added after the signing of this Agreement, the following terms shall apply: Clients’ album credit includes 25 pages; additional pages shall be billed at the rate of $30.00 per page for an 8x8 album and $35.00 per page for a 10x10 album. HLLP will complete an initial album design of its choosing, based upon its professional discretion, and Clients will be provided a digital proof of the album design for approval. Two rounds of simultaneously-requested changes by Clients will be included; any additional changes will be billed at the rate of $150.00 per hour. Clients will be provided an estimate for additional changes prior to commencement of additional editing by HLLP. Clients must have any album orders completed and approved for printing within 12 months from the date of delivery of the initial album digital proof, or Clients’ album credit shall be forfeited and any album would have to be purchased by the Clients separately at the current a la carte rate. Clients must sign off on the album design and pay all balances due in full prior to production / printing. There shall be no changes or reprints to the final printed album. In the event that the style of album selected is no longer available from the supplier, an item of like quality and similar style may be substituted.
ALBUMS. CIA Photography will supply the album and number of pages that has been ordered subject to any variations that CIA Photography or the Client may make. Any variations over and above that originally ordered by the Client will be charged at the rate current at the time of commission and will be added to the cost of the services over and above the details in the online booking form. Delivery times are defined by our suppliers and currently average eight weeks from client approval of layout. MODEL RELEASE The Client hereby grants to CIA Photography and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client hereby releases CIA Photography and its legal representatives and assigns from all claims and liability relating to said photographs.

It may involve reproductions in color or otherwise that may be made through any medium, and in any and all media now or hereafter known. Usage may include illustration, promotion, art, editorial, advertising, trade, or any other legal purpose. You also consent to the use of any printed matter in conjunction with that usage. You waive any right that you may have to inspect or approve the finished product, the advertising copy or other matter that may be used in that regard. I hereby waive any right that I may have to inspect or approve the finished product and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied. You agree that we, the Manager and our designees will have no liability due to any blurring, distortion, alteration, optical illusion, or use in composite form that may occur in taking or usage of any picture or in the subsequent processing or publication of the picture. You release us, the Manager, and our designees from all claims of any nature arising in any way from the use of your photograph or photographic image. This release contains the entire agreement on this subject matter.

  • Product ACCEPTANCE Unless otherwise provided by mutual agreement of the Authorized User and the Contractor, Authorized User(s) shall have thirty (30) days from the date of delivery to accept hardware products and sixty (60) days from the date of delivery to accept all other Product. Where the Contractor is responsible for installation, acceptance shall be from completion of installation. Failure to provide notice of acceptance or rejection or a deficiency statement to the Contractor by the end of the period provided for under this clause constitutes acceptance by the Authorized User(s) as of the expiration of that period. The License Term shall be extended by the time periods allowed for trial use, testing and acceptance unless the Commissioner or Authorized User agrees to accept the Product at completion of trial use. Unless otherwise provided by mutual agreement of the Authorized User and the Contractor, Authorized User shall have the option to run testing on the Product prior to acceptance, such tests and data sets to be specified by User. Where using its own data or tests, Authorized User must have the tests or representative set of data available upon delivery. This demonstration will take the form of a documented installation test, capable of observation by the Authorized User, and shall be made part of the Contractor’s standard documentation. The test data shall remain accessible to the Authorized User after completion of the test. In the event that the documented installation test cannot be completed successfully within the specified acceptance period, and the Contractor or Product is responsible for the delay, Authorized User shall have the option to cancel the order in whole or in part, or to extend the testing period for an additional thirty (30) day increment. Authorized User shall notify Contractor of acceptance upon successful completion of the documented installation test. Such cancellation shall not give rise to any cause of action against the Authorized User for damages, loss of profits, expenses, or other remuneration of any kind. If the Authorized User elects to provide a deficiency statement specifying how the Product fails to meet the specifications within the testing period, Contractor shall have thirty (30) days to correct the deficiency, and the Authorized User shall have an additional sixty (60) days to evaluate the Product as provided herein. If the Product does not meet the specifications at the end of the extended testing period, Authorized User, upon prior written notice to Contractor, may then reject the Product and return all defective Product to Contractor, and Contractor shall refund any monies paid by the Authorized User to Contractor therefor. Costs and liabilities associated with a failure of the Product to perform in accordance with the functionality tests or product specifications during the acceptance period shall be borne fully by Contractor to the extent that said costs or liabilities shall not have been caused by negligent or willful acts or omissions of the Authorized User’s agents or employees. Said costs shall be limited to the amounts set forth in the Limitation of Liability Clause for any liability for costs incurred at the direction or recommendation of Contractor.
