Abuse of Sick Leave Benefits. Abuse of sick leave privileges shall be grounds for disciplinary action. In addition, where an employee’s absence is such that the County has reasonable grounds to believe that an abuse of sick leave may exist, such employee shall be placed on “Restrictive Sick Leave”. Restrictive Sick Leave shall require the employee to provide the Jail Management designee a doctor’s statement as to the employee’s nature of illness, prognosis, employee’s ability to work/job specific limitations and anticipated period of absence/limitations. Once an employee is placed on Restricted Sick Leave, he/she will be counseled as to the proper use of sick leave and receive, in writing, notification of the Restricted Sick Leave status. Each imposition of Restricted Sick Leave shall be of reasonable duration, not to exceed nine (9) calendar months.

Abuse of Sick Leave Benefits. Abuse of sick leave privileges shall be grounds for disciplinary action. In addition, where an employee’s absences are such that the Employer has reasonable grounds to believe that an abuse of sick leave may exist, such employee will be notified of such suspected abuse and thereafter may be required, for up to a year following the day of each notice, to submit a satisfactory doctor’s Certificate or affidavit indicating the specific nature of the disability and its duration to the Department Head or designee before such absence may be charged against the employee’s accumulated sick leave balance. The Union will work cooperatively with the Employer to reduce and prevent abuses of sick leave.
