Prosecution History Files definition

Prosecution History Files means all files, documents and tangible things, as those terms have been interpreted pursuant to rules and laws governing the production of documents and things, constituting, comprising or relating to the investigation, evaluation, preparation, prosecution, maintenance, defense, filing, issuance, registration, assertion or enforcement of the Patents.
Prosecution History Files means all documentation to the extent relating to the Transferred Patents, to the extent maintained by the Seller or its Affiliates in the ordinary course of its patent prosecution practices, including the invention disclosures and related analyses or evaluations, related correspondence with the Patent and Trademark Office and applicable assignment documentation.
Prosecution History Files means all files, documents and tangible things, as those terms have been interpreted pursuant to Federal Rule of Civil Procedure 34, constituting, comprising or relating to investigation, evaluation, prosecution, filing and registration of the Seller Patents, and specifically includes e-mail messages and other electronic or computer stored or generated data.

  • Within a reasonable time after the Effective Date, Assignor will provide Assignee, or cause Assignee to be provided, with the Prosecution History Files, including the original ribbon letters patent or similar documents from each jurisdiction issuing a granted Assigned Patent.

  • Workers using davit systems for lowering or extracting workers from work areas (i.e. confined spaces) must be appropriately trained and competent in the use of the davit system.The anchor point and associated equipment shall be checked prior to use.

Prosecution History Files means all documents filed with the United States Patent and Trademark Office (USPTO) and any other files, documents and tangible things in the possession of the Seller, if any (as those terms have been interpreted pursuant to rules and laws governing the production of documents and things) that materially relate to the preparation, prosecution, maintenance, defense, filing, registration, assertion or enforcement of the Patents, including, without limitation, e-mail messages and other electronic and computer stored or generated data. Seller will provide what they have in their possession. Prosecution history is available to Purchaser from Patent Office.
