Phase 1 Commencement Date definition

Phase 1 Commencement Date means the earlier of (i) the date that Tenant commences business from the Phase 1 Expansion Premises; or (ii) December 1, 2017.
Phase 1 Commencement Date means the date on which HEP has notified Alon that, in HEP’s reasonable opinion, facilities associated with Phase 1 are available for service and operating as expected in delivering Refined Products.
Phase 1 Commencement Date means December 31, 2012 as set forth in Section 5.04 and Exhibit G hereof.

More Definitions of Phase 1 Commencement Date

Phase 1 Commencement Date shall be the date of the occurrence of the particular Lease Commencement Date which results in the Premises comprising 85,000 rentable square feet of space or more. As of the date of this Lease, the parties anticipate that the Phase 1 Lease Commencement Date shall occur on the Suite 700 Lease Commencement Date.
Phase 1 Commencement Date. (as herein defined) and shall be for a term (herein the "Term" or the "Lease Term") of seven (7) years, plus the portion of a calendar month, if any, from the Phase 1 Commencement Date to the last day of the calendar month in which the Phase 1 Commencement Date occurs. As used in this Lease, the term "Phase 1 Commencement Date", as advanced or postponed pursuant to the terms hereof, shall be defined as the earlier to occur of (a) the date on which Tenant takes possession and occupancy of the Phase 1 Premises, or (b) the date which is fifteen (15) days following that date which is the first on which all of the following events have occurred, namely (i) the Phase 1 Premises are "substantially completed", as defined in Section 2.1.1 following, (ii) Landlord has given Tenant written notice that the Phase 1 Premises are 2 substantially completed", and (iii) the "Phase 1 Target Date" as defined in Section 2.1.1 following has arrived. Tenant, at its sole risk, shall be permitted by Landlord to enter the Phase 1 Premises prior to the Phase 1 Commencement Date solely for the purpose of installing Tenant's fixtures and equipment, provided that (a) Tenant shall in each instance coordinate its entry and installation of equipment in the Phase 1 Premises in advance of Tenant's entry, and (b) Tenants activities shall be conducted so as not to unreasonably interfere with Landlord's Phase 1 Work (as hereinafter defined.)
Phase 1 Commencement Date shall be the earlier of (y) Tenant’s occupancy of the Phase 1 Premises and (z) the later of (i) the Estimated Phase 1 Commencement Date and (ii) the date on which Landlord’s Phase 1 Work is Substantially Complete. If possession is delayed by action of Tenant, then the Phase 1 Commencement Date shall be the date that the Phase 1 Commencement Date would have occurred but for such delay. Tenant shall execute and deliver to Landlord written acknowledgment of the actual Phase 1 Commencement Date and the Term Expiration Date within ten (10) days after Tenant takes occupancy of the Phase 1 Premises, in the form attached as Exhibit C hereto. Failure to execute and deliver such acknowledgment, however, shall not affect the Phase 1 Commencement Date or Landlord’s or Tenant’s liability hereunder. Failure by Tenant to obtain validation by any medical review board or other similar governmental licensing of the Phase 1 Premises required for the Permitted Use by Tenant shall not serve to extend the Phase 1 Commencement Date.

Phase 1 Commencement Date shall be the later of (a) the Estimated Phase 1 Commencement Date and (b) the day Landlord tenders possession of the Phase 1 Premises to Tenant with the Tenant Improvements Substantially Complete. If possession is delayed by action of Tenant, then the Phase 1 Commencement Date shall be the date that the Phase 1 Commencement Date would have occurred but for such delay. Tenant shall execute and deliver to Landlord written acknowledgment of the actual Phase 1 Commencement Date and the Term Expiration Date within ten (10) business days after Tenant takes occupancy of the Phase 1 Premises, in the form attached as Exhibit D-1 hereto. Phase 1 Commencement Date and (ii) with respect to the Phase 2 Premises, nine (9) months following the Phase 1 Commencement Date (the “Phase 2 Commencement Date”), and, unless sooner terminated or extended in accordance with the terms and conditions set forth herein, shall expire on the last day of the one hundred and twenty-fourth (124th) full calendar month after the Phase 1 Commencement Date (the “Expiration Date”).
Phase 1 Commencement Date means the date on which Contractor is to begin the Phase 1 Work pursuant to the Phase 1 Notice to Proceed.
