Phase 2 Commencement Date definition

Phase 2 Commencement Date means the date on which Phase 2 commences.
Phase 2 Commencement Date means the earlier of (i) the date that Tenant commences business from the Phase 2 Expansion Premises; or (ii) December 1, 2018.
Phase 2 Commencement Date means that date described in Section 5.04 and Exhibit G hereof. hereof.

  • No portion of the Work, with respect to the Phase 2 Services to be provided hereunder shall be performed prior to the Phase 2 Commencement Date, unless expressly approved in advance by Owner in writing.

  • Design Builder shall commence the Phase 2 Services portion of the Work within five (5) calendar days after the Phase 2 Commencement Date.

  • The total period of time beginning with the Phase 2 Commencement Date and ending on the date of Substantial Completion of the Work is referred to hereafter as the “Contract Time”.

  • If MOT is required, MOT is to be provided beginning with the Phase 2 Commencement Date.

  • That Substantial Completion date shall be established in terms of calendar days after the Phase 2 Commencement Date.


More Definitions of Phase 2 Commencement Date

Phase 2 Commencement Date means as described in Subsection 7.2D.
Phase 2 Commencement Date. (as herein defined) and shall continue for the remainder of the Term as defined in Section 2.1 hereof. As used in this Lease, the term "Phase 2 Commencement Date", as advanced or postponed pursuant to the terms hereof, shall be defined as the earlier to occur of (a) the commencement of the nineteenth (19th) calendar month of the Term; (b) the date on which Tenant takes possession and occupancy of the Phase 2 Premises, or (c) the date which is fifteen (15) days following that date which is the first on which all of the following events have occurred, namely (i) the Phase 2 Premises is "substantially completed", as defined in Section 2.2.1 following, (ii) Landlord has given Tenant written notice that the Premises are "substantially completed", and (iii) the "Phase 2 Target Date" as defined in Section 2.2.1 following has arrived. Tenant, at its sole risk, shall be permitted by Landlord to enter the Phase 2 Premises prior to the Phase 2 Commencement Date solely for the purpose of installing Tenant's fixtures and equipment, provided that (a) Tenant shall in each instance coordinate its entry and installation of equipment in the Phase 2 Premises in advance of Tenant's entry, and (b) Tenant's activities shall be conducted so as not to unreasonably interfere with Landlord's Phase 2 Work (as hereinafter defined.)
Phase 2 Commencement Date shall be the earlier of (y) Tenant’s occupancy of the Phase 2 Premises and (z) the later of (i) the Estimated Phase 2 Commencement Date and (ii) the date on which Landlord’s Phase 2 Work is Substantially Complete. If possession is delayed by action of Tenant, then the Phase 2 Commencement Date shall be the date that the Phase 2 Commencement Date would have occurred but for such delay. Tenant shall execute and deliver to Landlord written acknowledgment of the actual Phase 2 Commencement Date and the Term Expiration Date within ten (10) days after Tenant takes occupancy of the Phase 1 Premises, in the form attached as Exhibit C hereto. Failure to execute and deliver such acknowledgment, however, shall not affect the Phase 2 Commencement Date or Landlord’s or Tenant’s liability hereunder. Failure by Tenant to obtain validation by any medical review board or other similar governmental licensing of the Phase 2 Premises required for the Permitted Use by Tenant shall not serve to extend the Phase 2 Commencement Date.
Phase 2 Commencement Date means the date that Tenant is obligated to pay Base Monthly Rent with respect to the entire Phase 2
Phase 2 Commencement Date. [as defined in Section 4(b) of the Lease] has occurred, Base Monthly Rent with respect to the Expansion Premises shall be determined based upon (a) a rate of Twelve and 75/100 Dollars ($12.75) per rentable square feet of area contained within the lower level of the Adjacent Building, and (b) a rate of Twenty-Three and 00/100 Dollars ($23.00) per rentable square foot of area contained within the first and second floors of the Adjacent Building.
Phase 2 Commencement Date shall be the day Landlord actually tenders possession of the Phase 2 Premises to Tenant. If possession is delayed by action of Tenant, then the Phase 2 Commencement Date shall be the date that the Phase 2 Commencement Date would have occurred but for such delay. Landlord shall not be required to provide a tenant improvement allowance with respect to the Phase 2 Premises. Tenant shall execute and deliver to Landlord written acknowledgment of the actual Phase 2 Commencement Date within ten (10) business days after Tenant takes occupancy of the Phase 2 Premises, in the form attached as Exhibit D-2 hereto. Failure to execute and deliver such acknowledgment, however, shall not affect the Phase 2 Commencement Date or Landlord’s or Tenant’s liability hereunder. Failure by Tenant to obtain validation by any medical review board or other similar governmental licensing of the Phase 2 Premises required for the Permitted Use by Tenant shall not serve to extend the Phase 2 Commencement Date.
Phase 2 Commencement Date means the date on which the final Milestone relating to Phase 1 has been Achieved by the Contractor, as evidenced by DCC issuing the final Milestone Acceptance Certificate.
