Home Video Street Date definition

Home Video Street Date for each Included Program means the date on which such Included Program is first made available in the Territory on a non-exclusive basis to the general public in (unless otherwise specified herein) (a), with respect to Included Programs in Standard Definition format, the DVD format and (b) with respect to Included Programs in High Definition format, the HD DVD.
Home Video Street Date means, for a feature-length motion picture, the date on which such motion picture is first made available to the public for Home Video sale or rental in the Territory, which, in the case of an Included Program, shall be as notified by Licensor to Licensee from time to time as such dates are set.
Home Video Street Date for each Included Program in a Territory shall mean the date on which such Included Program is first made available in such Territory to the general public for sale or rental in DVD format and/or via DHE. For the avoidance of doubt, “DVD” means digital video discs in general, and includes Blu-ray discs as well as manufacture- on-demand or retail location-based download on demand to a DVD or other physical storage medium that is not a portable video device such as a Zune or iPod ( e.g., download via in-store kiosks)..

  • Without limiting the generality of the foregoing, LGF shall consult with Grantor with respect to thelselection of the initial Home Video Street Date of the Picture in the Territory.

More Definitions of Home Video Street Date

Home Video Street Date for each Included Program in a Territory shall mean the date on which such Included Program is first authorized by CDD (or its Affiliate) to be made available in such Territory to the general public for sale or rental in Home Video (as defined below) format. Notwithstanding the foregoing, “Home Video Street Date” shall specifically exclude any sale of an Included Program in the Home Video format bundled with a hardware product manufactured by an Affiliate of CDD (“Affiliate Bundle”).
Home Video Street Date for each Included Program in a Territory shall mean the date on which such Included Program is first made available in such Territory to the general public for sale or rental in Home Video (as defined below) format. Notwithstanding the foregoing, “Home Video Street Date” shall specifically exclude any sale of an Included Program in the Home Video format bundled with a hardware product manufactured by an Affiliate of CDD (“Affiliate Bundle”). “Home Video” as used herein means (i) with respect to any Included Program that Amazon is authorized to distribute solely in Standard Definition, a physically delivered standard definition home video format version thereof (e.g., a DVD, and whenever the term “DVD” is used in this Agreement, such term shall be deemed to mean a DVD or any other Home Video in Standard Definition format) and (ii) with respect to any Included Program that Amazon is authorized to distribute in [Approved 4K Resolution or] High Definition, a physically delivered high definition home video format version thereof (e.g., a Blu-ray disc and, whenever the term “Blu-ray disc” is used in this Agreement, such term shall be deemed to mean a Blu-ray disc or any other Home Video in High Definition format).
Home Video Street Date means the date on which such Current Film is first made available in the applicable Territory to the general public for sale or rental, whichever is earlier, in the DVD format. Notwithstanding the foregoing, Licensor may elect, in its sole discretion, to delay the Availability Date of up to ten percent (10%) (the “Applicable Percentage”) of the Current Films licensed hereunder in each Territory (each, an “Earlier Avail Title”) to provide for exclusive early distribution (i.e., distribution prior to the applicable Availability Date hereunder) through aany single Other Distributor on a one-off basis for VOD distribution in such Territory (“Earlier Avail Title”); provided, that: (a) the foregoing shall not be used to frustrate the purposes of this Agreement, and, in each such case, the Availability Date for such Current Film shall be no later than the date on which Licensor or any other SPE Entity makes such Current Film available to any other Other Distributor (i.e., on a non-exclusive basis) for VOD distribution in such Territory; (b) Licensee shall not be required to carry any such Earlier Avail Title in the applicable Territory; and (c) except in the event thatcase where such single Other Distributor is not an SPE Entity, the Applicable Percentage shall be five percent (5%), andan Affiliate of Licensor, no such Earlier Avail Title may have a North American box office of greater than Seventy-Five Million dollars ($75,000,000)., and (d) no more than half of all Earlier Avail Titles may be distributed on an exclusive early basis through an Other Distributor that is not an Affiliate of Licensor.
