  • Class Counsel Fees will be awarded at the discretion of the B.C. Court.

Court for an order approving this Settlement Agreement (the “ Settlement Approval Order”).

  • Contingent on the approval of the Settlement Agreement by the B.C. Court (and/or the Quebec Court, as necessary), the Settling Defendants have agreed to pay the settlement amount of CDN$2,750,000 all inclusive (the “Settlement Amount”) on behalf of the Settling Defendants, without any admission of liability, in accordance with this Settlement Agreement.

  • The remainder of the Settlement Amount will be remitted to Settlement Administrator in trust within thirty (30) business days of the Effective Date, unless otherwise ordered by the B.C. Court.

  • The Settling Defendants shall not be liable for any Honourarium to the Plaintiff Johnston or Class Members, if awarded by the B.C. Court.

  • The mechanics of the implementation and administration of this Settlement Agreement shall be determined by the B.C. Court, to the extent not provided for in this Settlement Agreement, if the Parties cannot agree.
