Filed Company SEC Documents means all Company SEC Documents that were filed and publicly available prior to the date of this Agreement.
Filed Company SEC Documents has the meaning set forth in Article IV.
Filed Company SEC Documents shall have the meaning set forth in the Article III Preamble.

  • Without limiting the foregoing, except as disclosed in the Filed Company SEC Documents, since the Balance Sheet Date there has not occurred any damage, destruction or loss (whether or not covered by insurance) of any material asset of the Company or any of its Subsidiaries which materially affects the use thereof.

Filed Company SEC Documents means the Company SEC Documents filed at least two (2) Business Days prior to the date hereof.
