Environmental Mitigation Projects definition

Environmental Mitigation Projects or “Projects” means the projects set forth in Section IX (Environmental Mitigation Projects) and Appendix A of this Consent Decree, and any other project undertaken for the purpose of fulfilling Defendant’s obligations under Section IX and Appendix A and approved for that purpose by EPA pursuant to Section XIII (Review and Approval of Submittals).
Environmental Mitigation Projects means the requirements specified in Section V and Appendix B of this Consent Decree to remedy, reduce, or offset past excess ozone precursor emissions resulting from PDC’s alleged violations of the Clean Air Act in this matter. Ozone is formed by chemical reactions between VOC and oxides of nitrogen (NOx) in the presence of sunlight.
Environmental Mitigation Projects means the requirements in Section VII and Appendix B to mitigate the alleged environmental harm caused by the alleged noncompliance at Aux Sable’s Facility.

Examples of Environmental Mitigation Projects in a sentence

  • Defendants shall implement the Environmental Mitigation Projects (“Projects”) described in Appendix A to this Consent Decree and fund the categories of Projects described in Subsection B, below, in compliance with the approved plans and schedules for such Projects and other terms of this Consent Decree.

  • Upon approval of the plans required by this Appendix by EPA, Defendants shall complete the Environmental Mitigation Projects according to the approved plans.

  • In case of early termination as stipulated in articles13.1 to 13.2, Kemin will not be required to pay any further fees, damages, nor to refund the amounts already paid by the Customer or pay compensation in any form to the Customer.

  • Defendants shall spend no less than a total of $10 million in Project Dollars on Land Acquisition and Restoration over the five year period provided under this Appendix for completion of federally directed Environmental Mitigation Projects.

  • Nothing in this Consent Decree shall be interpreted to prohibit Defendants from completing Environmental Mitigation Projects before the deadlines specified in the schedule of an approved plan.


More Definitions of Environmental Mitigation Projects

Environmental Mitigation Projects or “Projects” means the projects identified in Section IX and Appendix A of this Consent Decree.

Environmental Mitigation Projects means the requirements in Paragraphs 69 - 75 (Acetylene Vents 322 Building Project and Thermal Oxidizer Reliability Improvement Project) to mitigate the alleged environmental harm resulting from alleged noncompliance at Defendant’s Facility;
Environmental Mitigation Projects or “Projects” means the projects set forth in Section IX (Environmental Mitigation Projects) and Appendix A of this Consent Decree.
Environmental Mitigation Projects means the requirements in Paragraphs 69-73 applicable to air-cooled heat exchangers (Fin Fan Units), and in Paragraphs 96-100 (Compressor Stations Mitigation Projects) applicable to natural gas compressor stations, to mitigate the environmental harm allegedly caused by noncompliance at Defendants’ Covered Facilities.
Environmental Mitigation Projects means one or more projects required to settle or pay CAA Claims brought by the United States pursuant to Sections 113(b)(2) and 167 of the CAA, 42 U.S.C. §§ 7413(b)(2) and 7477, or a citizen pursuant to Section 304 of the CAA, 42 U.S.C. § 7604, in the NSR Litigation through the Consent Decree. “Environmental Mitigation Projects” are not a civil penalty as that term is defined by Section 113(b)(2) of the CAA, 42 U.S.C. § 7413(b)(2).
Environmental Mitigation Projects means the requirements in Paragraph 33 for implementation of an Optical Gas Imaging Program and the requirements in Section VII for implementation of an emissions reduction project to mitigate environmental harm allegedly caused by noncompliance at the Covered facilities.
