Environmental Condition definition

Environmental Condition has the meaning ascribed to it in Part E of the Network Code; "Environmental Damage" has the meaning ascribed to it in Part E of the Network Code; "European licence" has the meaning ascribed to it in section 6(2) of the Act;
Environmental Condition means any contamination or damage to the environment caused by or relating to the use, handling, storage, treatment, recycling, generation, transportation, release, spilling, leaching, pumping, pouring, emptying, discharging, injection, escaping, disposal, dumping or threatened release of Hazardous Materials by any Person. With respect to claims by employees or other third parties, Environmental Condition also includes the exposure of Persons to amounts of Hazardous Materials.
Environmental Condition means a condition relating to or arising or resulting from a failure to comply with any applicable Environmental Law or Environmental Permit or a Release of Hazardous Materials into the Environment.

  • To Seller’s Knowledge, except as set forth in the ESA, there is no Environmental Condition (as such term is defined in ASTM E1527-05 or its successor) at any related Mortgaged Property.

More Definitions of Environmental Condition

Environmental Condition means a condition agreed under section 48F of the EP Act or decided under section 48J of the EP Act.
Environmental Condition means (i) the presence or Release of a Hazardous Substance in the Environment with respect to the Project or the Project Site that is in violation of an Environmental Permit or that is not allowed, approved or permitted by an Environmental Permit for which there is an obligation under Environmental Law to engage in any monitoring, investigation, assessment, treatment, cleanup, containment, removal, mitigation, reporting, response or restorative work, or which concerns a matter over which a Governmental Authority has imposed requirements or obligations under Environmental Laws, or (ii) a violation of Environmental Law.
Environmental Condition means the presence or Release of a Regulated Substance (other than a naturally-occurring substance) on or in environmental media, or structures on Real Property, at an Off-Site Location or other property (including the presence in surface water, groundwater, soils or subsurface strata, or air), including the subsequent migration of any such Regulated Substance, regardless of when such presence or Release occurred or is discovered.
Environmental Condition means any condition with respect to soil, surface waters, groundwater, land, stream sediments, surface or subsurface strata, ambient air and any environmental medium comprising or surrounding the Real Property, which results in any damage, loss, cost, expense, claim, demand, order or liability to or against Seller or Buyer by any third party (including, without limitation, any government entity) as a result of a violation of any applicable Environmental Laws.
Environmental Condition means any actual or alleged violation or liability subject to any Environmental Law including the presence or release into the environment of any Hazardous Substance as a result of which any Seller (i) is or could reasonably be expected to become liable to any person, (ii) is in violation of any Environmental Law, (iii) is or could reasonably be expected to incur response costs for investigation or remediation, or (iv) by reason of which any Hotel Assets or other assets of any Seller, could reasonably be expected to be subject to diminution in value or any lien relating to Environmental Laws.
Environmental Condition means the Release of any Hazardous Materials in, over, on, under, through, from or about the Project (including, but not limited to, the Premises).
Environmental Condition means any adverse condition relating to any Hazardous Materials or the environment, including surface water, groundwater, drinking water supply, land, surface, or subsurface strata, or the ambient air, and includes air, land, and water pollutants, noise, vibration, light, and odors in violation of any Environmental Laws.
