Elite Coaching Apprenticeship Programme. “Team 2012”, “International Inspiration” or such other programmes or projects UK Sport may fund, run or be involved in from time to time (“Projects or Programmes”) or use any trade marks, trade names or logos so resembling such Projects or Programmes as to be likely to cause confusion with such Projects or Programmes, unless otherwise authorised by UK Sport in writing to do so; represent, directly or indirectly, that the Supplier, its products or services are in any way associated with UK Sport, or that any product or service provided has been endorsed or approved by UK Sport, including by publishing or issuing any statement (factual or otherwise) about UK Sport, or the Supplier’s provision of products or services in connection with the Services/Supplies, unless otherwise authorised by UK Sport in writing to do so; undertake any form of ambush marketing, which shall include any activity, whether commercial or non-commercial, that creates, implies or refers to a direct or indirect association of any kind (including an association in the minds of members of the public) with UK Sport and/or its Projects or Programmes; cause to be done, or permit anyone reasonably within the Supplier’s control to do, anything which might damage or endanger the validity or distinctiveness of, or the goodwill in, the Marks or other intellectual property rights of UK Sport; or do anything which would have an adverse effect on or embarrass UK Sport, or any official supporter of sponsor of UK Sport in the context of its sponsorship of its Projects or Programmes and the Supplier agrees: to take reasonable steps to ensure that any of its contractors or agents providing goods or services specifically in relation to the Services shall also abide by the provisions of this clause. UK Sport shall have the right to enforce the terms of clause 1.1 above in accordance with the Contracts (Rights of Third Parties) Xxx 0000, and the Supplier acknowledges the provisions therein are of such importance to UK Sport that damages may not be an adequate remedy for breach of clause 1.1 by the Supplier and that injunctive relief may be a more appropriate remedy.
