Defect” or “Defective definition

Defect” or “Defective means non-conformity to the quantity, quality, specifications, and/or other requirements set out in the Contract Documents;

Examples of Defect” or “Defective in a sentence

  • Any demonstrable failure of a Product to meet the warranty set forth in clause 3 of these Warranty Conditions (a "Defect" or "Defective Product") must be reported to Esdec in writing (including by email) by the Purchaser promptly upon becoming aware thereof, thereby including all information reasonably known to the Purchaser in respect of the alleged Defect, including, as appropriate, photographs or video recordings of the alleged Defect.

  • Defect or Defective includes, in relation to the Goods, any omission, error, fault, non-compliance, breach of Law, deficiency, flaw, irregularity, material imperfection, or similar condition and if Installation is required, any defect in Installation.

  • Defect or Defective means, in relation to the Services, any omission, error, fault, non-compliance, breach of Law, deficiency, flaw, or similar condition.


More Definitions of Defect” or “Defective

Defect” or “Defective means a part of the Goods which is not in accordance with the Purchase Order.
Defect” or “Defective means Goods or Services (or any aspect of them) which are not in accordance with the Contract or which are damaged, incomplete or have any defect, flaw, deficiency or omission in them. Defects Liability Period means the period of 12 months commencing on the later of the date of the last delivery of the Goods to Fleetwood Building Solutions, and the date on which the Services were last performed for Fleetwood Building Solutions.
Defect” or “Defective means not meeting the requirements of clauses 6, 8 and 12.

Related to Defect” or “Defective

  • Minor defect means a defect which is not a Major Defect.

  • Environmental Defect means, with respect to any given Asset, a material violation of Environmental Laws in effect as of the Effective Time in the jurisdiction in which such Asset is located.

  • Latent Defect means a defect, inherently lying within the material or arising out of design deficiency, which do not manifest themselves and/or was not reasonably discoverable during Defect Liability period.

  • Latent Defects means such defects caused by faulty designs, material or work-man- ship which cannot be detected during inspection, testing etc, based on the technology available for carrying out such tests.

  • Major Defect means a condition that exists on a ground ambulance vehicle that requires the Department or the certificate holder to place the ground ambulance vehicle out-of-service.

  • Environmental Defect Notice shall have the meaning set forth in Section 12.1(a).

  • Defect Notice shall have the meaning specified in Section 3.2 of this Agreement.

  • Environmental Defect Value means, with respect to any Environmental Defect, the value, as of the Closing Date, of the estimated costs and expenses to correct such Environmental Defect in the most cost-effective manner reasonably available, consistent with Environmental Laws, taking into account that non-permanent remedies (such as mechanisms to contain or stabilize hazardous materials, including monitoring site conditions, natural attenuation, risk-based corrective action, institutional controls or other appropriate restrictions on the use of property, caps, dikes, encapsulation, leachate collection systems, etc.) may be the most cost-effective manner reasonably available.

  • Material Defect As defined in Section 2.02(c) hereof.

  • Title Defect means with respect to a Lease any lien, encumbrance, adverse claim, default, expiration, failure, defect in or objection to real property title, other than Permitted Encumbrances, that alone or in combination with other defects renders Sellers’ title to the Lease less than Defensible Title.

  • Nonconformity or “Nonconformities” means any failure or failures of the Software to conform to the requirements of this Contract, including any applicable Documentation.

  • Title Defects has the meaning set forth in Section 5.15(b).

  • Construction defect means a deficiency in or a deficiency arising out of the design, specifications, surveying, planning, supervision, or observation of construction or construction of residential improvements that results from any of the following:

  • Nonconforming lot means a lot that met dimensional requirements of the applicable master program at the time of its establishment but now contains less than the required width, depth or area due to subsequent changes to the master program.

  • Nonconformance as used in this clause means a condition of any hardware, software, material, or service/workmanship in which one or more characteristics do not conform to requirements.

  • Loss or Losses means all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs or expenses of whatever kind, including reasonable attorneys' fees and the costs of enforcing any right to indemnification hereunder and the cost of pursuing any insurance providers.

  • Title Defect Notice shall have the meaning set forth in Section 11.2(a).

  • Environmental Condition means any condition or circumstance, including the presence of Hazardous Substances which does or would (i) require assessment, investigation, abatement, correction, removal or remediation under any Environmental Law, (ii) give rise to any civil or criminal Liability under any Environmental Law, (iii) create or constitute a public or private nuisance or (iv) constitute a violation of or non-compliance with any Environmental Law.

  • Mentally defective means that a person suffers from a mental disease or defect which renders the person temporarily or permanently incapable of appraising the nature of his or her conduct. S.C. Code Ann. §

  • Environmental Conditions means the presence in the environment, including the soil, groundwater, surface water or ambient air, of any Hazardous Material at a level which exceeds any applicable standard or threshold under any Environmental Law or otherwise requires investigation or remediation (including, without limitation, investigation, study, health or risk assessment, monitoring, removal, treatment or transport) under any applicable Environmental Laws.

  • Seller Losses shall have the meaning set forth in Section 9.1(b).

  • Title Defect Amount means, with respect to a Title Defect Property, the amount by which such Title Defect Property is impaired as a result of the existence of one or more Title Defects, which amount shall be determined as follows:

  • Casualty Loss has the meaning set forth in Section 5.06.

  • Buyer Losses shall have the meaning set forth in Section 8.2.

  • Title Defect Property has the meaning set forth in Section 6.2(a).

  • Nonconforming structure means a structure the size, dimension or location of which was lawful prior to the adoption, revision or amendment of a zoning ordinance, but which fails to conform to the requirements of the zoning district in which it is located by reasons of such adoption, revision or amendment.
