Company Document definition

Company Document means any prospectus (howsoever described) or supplement thereto of the Company or the constitutional documents of the Company or such other documentation issued by or entered into by the Company which is material to the Certificates in the determination of the Calculation Agent;
Company Document means the operative organizational documents of a Company, such as the certificate of incorporation, by-laws, partnership agreement, certificate of partnership and limited liability company agreement and shall include, with respect to the Borrower, the Recap Agreement.
Company Document means any of the Company Documents;

More Definitions of Company Document

Company Document means this Agreement, the Voting Agreement and each other agreement, document, instrument and certificate required to be executed by or on behalf of the Company or the Shareholders’ Representative in connection herewith or therewith.
Company Document means (a) all Subject Instruments and (b) all other contracts, indentures, mortgages, deeds of trust, loan or credit agreements, bonds, notes, debentures, evidences of indebtedness, swap agreements, leases or other instruments or agreements to which the Company or any of its subsidiaries is a party or by which the Company or any of its subsidiaries is bound or to which any of the property or assets of the Company or any of its subsidiaries is subject that solely in the case of this clause (b), are material with respect to the Company and its subsidiaries taken as a whole.
Company Document means any of the Company Documents; and "Existing Credit Agreement" means the Credit Agreement dated as of March 5, 1999, as amended, among the Company, the lenders party thereto and First Union National Bank, as administrative agent, including any promissory notes, pledge agreements, guarantees and other instruments or agreements entered into by Company or any of its subsidiaries in connection therewith. The Other Agreement is sometimes referred to as the "Common Stock Agreement". The Company understands that the Underwriters propose to make a public offering of the Securities as soon as the Representatives deem advisable after this Agreement has been executed and delivered and the Indenture has been qualified under the Trust Indenture Act of 1939, as amended.
Company Document means any indenture, mortgage, deed of trust, loan agreement, lease or other agreement or instrument to which the Company or any of its Material Subsidiaries is a party or by which the Company or any of its Material Subsidiaries is bound or to which any of the property or assets of the Company or any of its Material Subsidiaries is subject.
Company Document means each or any instrument executed and delivered by any one or both of the Shareholder and the Company in connection with the transactions contemplated hereby.
