Vulnerable Subjects Clause Samples
The 'Vulnerable Subjects' clause defines how individuals who may be at increased risk or have diminished capacity—such as children, the elderly, or those with cognitive impairments—are identified and protected within the context of an agreement or research protocol. This clause typically outlines additional safeguards, consent requirements, or oversight measures that must be implemented when engaging with these populations. Its core function is to ensure that vulnerable individuals are not exploited or exposed to undue risk, thereby upholding ethical standards and legal compliance.
Vulnerable Subjects. Vulnerable subjects will not be enrolled.
Vulnerable Subjects. OCSO agrees to develop and implement an ECW policy that prohibits, absent exigent circumstances, deployment of the ECW against the following subjects, or under the following circumstances:
(1) in an environment where the subject’s fall may cause substantial injury or death (e.g., an elevated location such as rooftop or building ledge; standing in or near water or other drowning hazards; or climbing a fence or wall);
(2) against a subject in physical control of a vehicle in motion, including a bicycle;
(3) against an apparently helpless person or an individual with an apparent severe disability;
(4) against a reasonably apparent young child;
(5) against a reasonably apparent elderly person;
(6) against a female person reasonably believed to be pregnant;
(7) within an elementary school.
Vulnerable Subjects. Certain populations are considered to be vulnerable and require special protections when asked to participate in a research study. (Vulnerable populations include, but are not limited to pregnant women, fetuses, human embryos, prisoners, children, and cognitively impaired individuals or persons with questionable capacity to consent. Others which may require special consideration include elderly persons, economically disadvantaged persons and educationally disadvantaged persons.) Children include all persons who have not attained the legal age for consent to treatments or procedures involved in the research under the applicable law of the jurisdiction in which the research will be conducted (the age of majority is 18 years in the Connecticut). Parental permission and the child's assent is required for participation in the study. (Assent is defined as "a child's affirmative agreement to participate in research" and should be sought in addition to parental permission when the minor subject is sufficiently mature to understand the nature of his or her participation in a research study.)
