Title and Restrictions. 4.1 Title and Copyright. This Agreement confers no ownership rights to Customer and is not a sale of any rights in the Software, the Documentation, or the media on which either is recorded or printed. Customer does not acquire any rights, express or implied, in the Software or the Documentation, other than those rights as a licensee specified in this Agreement. All Software and Documentation furnished by Xecurify, and all copies thereof made by Customer and all compilations, derivative products, programmatic extensions, patches, revisions, and updates made by either party, and any, patent rights, copyrights, trade secrets, trademarks, trade names, service marks, designs or design marks or proprietary inventions, designs and information included within any of the items described above are and shall remain the property of Xecurify or Xecurify's licensors, as applicable. Customer agrees not to claim or assert title to or ownership of the Software or the Documentation. Customer will not remove or alter any copyright or proprietary notice from copies of the Software or the Documentation and copies made by or for Customer shall bear all such copyright, trade secret, trademark and any other intellectual property right notices on the original copies.

Title and Restrictions. Organization acknowledges that title to and ownership of the Curb Products, including, without limitation, any derivative or ancillary services or technologies thereof, and all related technical know-how and all intellectual property rights therein (including without limitation rights in patents, copyrights, and trade secrets applicable thereto), are and shall remain the exclusive property of Curb and its affiliates. Curb grants to Organization a non-exclusive, non-transferable, limited license to use such Curb Products for the sole purpose of enabling Organization and its Designated Users to utilize such Curb Products as intended, subject to the provisions in any separate license agreement or other document that may be supplied by Curb to the Organization. Organization and its Designated Users shall have no right to market, distribute or otherwise transfer such Curb Products.

  • Use and Restrictions Your rights and obligations concerning the use of any Error Corrections or new Product Releases (or any other programming provided by Gurobi, regardless of its form or purpose) shall be governed by the License Agreement. Gurobi shall have sole and exclusive ownership of all right, title, and interest in and to such works (including ownership of all copyrights, patent rights, trade secret rights and other intellectual property rights pertaining thereto), subject only to the License Agreement. Unless otherwise agreed, You are entitled to use the Product only as authorized under the License Agreement.   • USAGE RIGHTS AND RESTRICTIONS 5.1 To the extent another Cloud Service is a prerequisite for the usage of the CAE Services, the usage rights and restrictions of the respective Cloud Service shall apply to the CAE Services. To the extent another Cloud Service is not a prerequisite for the usage of the CAE Services, the usage rights and restrictions of the GTC shall apply accordingly to the CAE Services in addition to the usage rights and restrictions of the Order Form, as the case may be.
