Right to Market. Evergreen hereby grants to the Distributor the nontransferable right to market and sell at retail the products and all its future products bearing the "Tab Force(TM)" trademark in the territory assigned by this Agreement.
Right to Market. Purchaser acknowledges that, between the date hereof and the end of the Inspection Period (as hereinafter defined), Xxxxxx Xxxx Xxxxxxx, Inc. ("Seller's Agent") will continue for Seller's benefit to market the Business and the Purchased Assets for sale to third parties. Unless Purchaser elects to terminate this Agreement during the Inspection Period (as hereinafter defined) as provided in Section 5.5 hereof, such right to market the Business and/or any of the Purchased Assets shall automatically terminate upon the expiration of the Inspection Period and be of no force or effect. Purchaser may, as a result of such marketing efforts, receive offers to purchase the Purchased Assets. However, notwithstanding the marketing right described in this Section 1.5, Seller shall have no right whatsoever, whether directly or through its agents or Affiliates (as herein defined), to negotiate such offers, or to enter into any agreement, contract, letter of intent or other arrangement for the sale of Seller's Business and/or any of the Purchased Assets, unless and until Purchaser terminates this Agreement or this Agreement is terminated as a result of Purchaser's default hereunder.
Right to Market. NU SKIN PRODUCTS AND SPONSOR IN MY RESIDENT COUNTRY Subject to the terms and conditions of the Brand Affiliate Agreement, NSI grants to me (a) the right to be a Brand Affiliate and market Nu Skin Products in my Resident Country through person-to-person sales primarily in the home, and (b) sponsor new Brand Affiliates in my Resident Country. I agree that this Brand Affiliate Agreement will be accepted in Utah.
Right to Market. Nothing in this Agreement shall impair Spinway's right to license, market, co-market, brand, or co-brand the Spinway Service or develop a similar relationship as contemplated by this Agreement with any other party.
Right to Market. In addition, as of the Effective Date, the County grants the Developer the right to market the Building to prospective tenants, by taking any, or all, of the following actions: hiring a real estate broker(s), placing commercially reasonable signs or other marketing materials on or about the Building (subject to Applicable Laws, collectively, the "Marketing Materials"), entering the Property and showing the Building to prospective tenants (or other users), potential lenders, and potential investors, and negotiating agreements with prospective users. Such right granted herein shall automatically terminate upon a Developer Event of Default or upon termination of this Agreement, and upon such termination, the Developer shall, or shall cause, the prompt removal of any personal property, including, but not limited to Marketing Materials located at the Property. As between the Developer and the County, the Developer shall be solely obligated for all costs and expenses incurred by the Developer in connection with the right granted herein, and at the sole risk of the Developer.
Right to Market. Subject to the terms and conditions of these Referral Partner Terms, Proof grants to the Referral Partner the non-exclusive, non-transferable, and non-assignable right to market the Services to any Prospect for the specific purpose of encouraging Prospects in need of Proof Services to click-through the Referral Partner Link.
Right to Market. Nu Skin Products and Sponsor in the United States Subject to the terms and conditions of the Distributor Agreement, NSEUS grants to me (a) the right to be a Distributor and market Nu Skin Products in the United States through person-to-person sales, and (b) sponsor new Distributors in the United States.
Right to Market. Until the expiration of the Cancellation Period, each Seller will have the right to negotiate and enter into a letter of intent or other written agreement providing for the sale to any third party of any of the Category B Locations. If a Seller enters into such a letter of intent or agreement, each Category B Location (together with its related Assets) which is the subject of such a letter of intent or agreement will be deemed to be Excluded Assets and the price for the Category B Locations will be reduced by an amount equal to the purchase price which such Seller has agreed to accept for such Location(s).
Right to Market. Lockwood grants to PCI the xxxxxxxxe right to market the Magazine to all retailers which display or sell the PCI Products in North America (the "Retailers"). During the term of this Agreement, neither Lockwood nor any representxxxxxx xf Lockwood shall be xxxxxxxx to market the Magazine to any such Retailers. PCI shall have no duty, right or other obligation to market the Magazine to, or to maintain any relationship with, any Retailer which has discontinued and no longer carries the PCI Products. The parties hereto acknowledge that "Smoke Magazine" is the featured magazine of PCI. However, nothing contained within this Agreement shall limit PCI's right to market, sell or distribute any products, including other magazines, with the PCI Products.
