Timing of Design and Construction. The City shall commence and complete its design and construction obligations with respect to the 000xx Xxxxxx Improvements on a schedule to be determined by the City in its sole discretion; provided, however, in the event that Developer determines that it requires said design and construction work to be completed prior to the City’s intended commencement of the same, Developer may deliver written notice of such requirements to the City and the City, within thirty (30) days of receiving Developer’s notice, shall notify Developer in writing as to which of the following two options it has selected in its sole discretion: (i) to meet Developer’s stated design and construction schedule; or (ii) allow Developer to undertake said design and construction obligations, with all such costs to be shared equally between the City and Developer and such costs that are incurred by Developer shall be an Eligible Expense hereunder. If the City elects to meet Developer’s construction schedule but fails to timely complete construction the 000xx Xxxxxx Improvements, then Developer shall be entitled to the self-help rights set forth in Section 2.03(c)(iii) below.

Timing of Design and Construction. It is the intent of the Diversion Authority that the O-H-B Levee be designed beginning in 2013 with acquisition of land, buildings (including houses) and improvements beginning as soon as the routing of the levee is finalized and the land for the project is identified and with construction to commence in 2014. Acquisition of said land, buildings (including houses) and improvements will be in accordance with applicable state and federal laws and regulations including, but not limited to, the Uniform Relocation Assistance and Real Property Acquisition Act of 1970 and/or N.D.C.C. Chapter 54-01.1 and the timing thereof coordinated with the City of Oxbow.. It is further intended, therefore, that design and construction of the O-H-B Levee may commence before the Metro Flood Project, as a whole, receives authorization from the United States Congress. This will be contingent upon successful negotiation with the Corps of a memorandum of understanding that will allow the O-H-B Levee to be constructed prior to said authorization. The Diversion Authority intends that the sequence of construction will staged so that construction of the new golf course holes, modification of existing golf holes that will remain within the protected area, and construction of the new clubhouse, practice area, swimming pool and parking lot shall be complete prior to the removal of the existing Oxbow Golf &Country Club buildings and land for purposes of building the O-B-H Levee.
Timing of Design and Construction. KTA has indicated its intention to let the Public Infrastructure on or before , 2019 and to complete the Public Infrastructure on or before October 31, 2020.

Mechanisms are to be constructed to avoid sticking due to rust or corrosion. Workmanship and general finish are to be of the highest class throughout. All similar parts of the material are to be interchangeable. All equipment is to operate without undue vibration and with the least possible amount of noise and is not to cause a nuisance. All equipment is to be designed to minimize the risk of fire and any damage, which may be caused in the event of fire. The equipment is also to be designed to prevent ingress of all vermin, accidental contact with live parts and to minimize the ingress of dust and dirt. The use of materials, which may be liable to attack by termites or other insects, is to be avoided.
