Term of Service. Except as otherwise provided in this Agreement, Atlas shall serve as the Managing General Partner of the Partnership until either it:

Notwithstanding the Effective Date of this Agreement, the ESP acknowledges that it may only offer Direct Access Services to customers effective January 1, 1998, or such other date as may be directed by the CPUC for commencement of such services by ESPs, and only after it has complied with all provisions of this Agreement and PG&E's applicable tariffs.

The member’s eligibility for subsequent terms of service with the Program will be based on, at least, a mid-term and end-of-term evaluation of the member’s performance focusing on factors such as whether the member: I. Completed the required number of hours; II. Satisfactorily completed assignments, tasks, or projects; and III. Meets any other criteria that were clearly communicated both orally and in writing at the beginning of the term of service. h. The mere eligibility for an additional term of service does not guarantee selection or enrollment in a subsequent term.
