The Contractor shall not select any Subcontractors who a) are currently ineligible, debarred (or in the process of being debarred), suspended (or in the process of being suspended), or otherwise excluded (or in the process of being excluded, from bidding on or contracting with any state or federal agency, department, or authority; b) that have been terminated for cause within five (5) years or are currently in default on a public works construction project, or c) have a Worker’s Compensation Experience Modification Rate (EMR) over the past three years exceeding an average of 1.2.
