Sublessor's Right to Perform. Sublessor may itself pay or perform or cause to be paid or performed the obligations with respect to which Subtenant is in default. In the event Sublessor does so, its costs of such payment or performance, including a reasonable attorney's fee and all expenses incurred by Sublessor, plus interest thereon at the rate of fifteen percent (15%) per annum from the date of the expenditure, shall be deemed to be additional rent and shall be immediately paid by Subtenant.

Sublessor's Right to Perform. Upon Sublessee's failure to perform any obligation of Sublessee hereunder, including, without limitation, payment of Sublessee's insurance premiums and charges of contractors who have supplied materials or labor to the Sublease Premises, Sublessor shall have the right, but not the obligation, to perform such obligations of Sublessee on behalf of Sublessee or to make payment on behalf of Sublessee to such parties, or both. Upon demand, Sublessee shall reimburse Sublessor for the cost of Sublessor's performing such obligations on Sublessee's behalf, including, without limitation, reimbursement of any amounts that may be expended by Sublessor and Sublessor's reasonable attorneys' fees, plus interest at the Interest Rate, from the date of any such expenditure until the same is repaid.
Sublessor's Right to Perform. If the Sublessee fails to make any payment required to be made by it hereunder or under any Facility Sublease Document or fails to perform or comply with any of its other agreements contained herein or obligations under the Facility Lease assumed by it pursuant to Section 2.2 after notice to the Sublessee and failure of the Sublessee to so perform or comply within ten (10) days thereafter in the case of a failure to make any payment or thirty (30) days thereafter in all other cases, the Sublessor may itself make such payment or perform or comply with such agreement in a reasonable manner, but shall not be obligated hereunder to do so, and the amount of such payment and of the reasonable expenses of the Sublessor incurred in connection with such payment or the performance of or compliance with such agreement, as the case may be, together with interest thereon at the Overdue Rate, to the extent permitted by Applicable Law, shall be deemed payable by the Sublessee to the Sublessor on demand.

All sums paid by Sublessor and all penalties, interest and costs, including, but not limited to, collection and attorneys' fees reasonably incurred in connection therewith, shall be due and payable by Sublessee to Sublessor, as an item of Additional Rent, on demand by Sublessor, together with interest thereon at the Applicable Rate from the date of such demand until paid by Sublessee.
Sublessor's Right to Perform. If an Event of Default shall have occurred and be continuing, then, in addition to any rights or remedies of Sublessor under Section 13.2 hereof, within five (5) days after notice (or in case of an emergency, without notice) to Sublessee, Sublessor may, at its option and without any obligation to do so, make any payment to be made by Sublessee pursuant to the terms hereof or perform any obligation to be performed by Sublessee pursuant to the terms hereof. The costs and expenses of any such payment or performance by Sublessor (including reasonable attorneys' and other professionals' fees and expenses) shall be deemed to be Rent hereunder and shall be due and payable by Sublessee upon demand, along with interest thereon as provided in Section 13.4 hereof.

Whenever practicable, Landlord, before proceeding as provided in this Section 12.4, shall give Tenant notice in writing of the failure of Tenant which Landlord proposes to remedy, and shall allow Tenant such length of time as may be reasonable in the circumstances, consistent with any grace periods contained herein, but not exceeding 30 days from the giving of notice, to remedy the failure itself and, if Tenant shall not remedy the failure in the time so allowed, Landlord shall be deemed to have given “due notice” and may proceed as provided in this Section 12.4; provided that nothing in this Section shall prevent Landlord from acting without notice to Tenant in case of any emergency wherein there is danger to property or person or where there may exist any violation of legal requirements including but not limited to the presence of Hazardous Materials, in which event no notice shall be required.

  • LANDLORD’S RIGHT TO PERFORM TENANT’S DUTIES If Tenant fails timely to perform any of its duties under this Lease, Landlord shall have the right (but not the obligation), to perform such duty on behalf and at the expense of Tenant without prior notice to Tenant, and all sums expended or expenses incurred by Landlord in performing such duty shall be deemed to be additional Rent under this Lease and shall be due and payable upon demand by Landlord.

All sums so paid by the Lessor and all costs and expenses (including, without limitation, reasonable attorneys' fees and expenses, in each case, to the extent permitted by law) so incurred shall be paid by the Lessee to the Lessor on demand as an Additional Charge. The obligations of the Lessee and rights of the Lessor contained in this Article shall survive the expiration or earlier termination of this Lease.
