Except as expressly provided elsewhere in the Agreement, the Contractor does not warrant that the Owner Supplied Materials are free of Deficiencies.
For clarity, this does not limit any warranty obligations of the Contractor for Work in respect of, or in connection with, the Owner Supplied Materials.

In the event that Customer provides any designs, labels, or other instructions for the manufacture of the Goods (collectively "Customer Supplied Materials"),the Customer shall be responsible for verification of whether the Goods we manufacture in accordance with the Customer Supplied Materials infringe the intellectual property rights of third parties.
The Parties agree that LONZA is responsible for the procurement of LONZA Supplied Materials, including with respect to transporting, testing, inspecting and storing the LONZA Supplied Materials; maintaining systems for management of LONZA Supplied Materials; and maintaining adequate supplies of LONZA Supplied Materials based on binding forecasts.
The Customer will indemnify, hold harmless and defend us against all and any claims, demands, actions, costs, liabilities, losses and damages of any kind (including attorneys' fees) arising in connection with third party claims that the Goods infringe or misappropriate intellectual property rights as a result of use of Customer Supplied Materials.
Flexion will give Patheon written authorization to order Patheon Supplied Materials for any launch quantities of Product request by Flexion which will be considered a Purchase Order when accepted by Patheon.
LONZA shall not be responsible for raw material shortages or supplier delays outside of its control to the extent it diligently complied with its duties to procure and maintain adequate LONZA supplies Supplied Materials.
