Statement of Intent Regarding Progressive Discipline. Under the Progressive Discipline Section of this collective bargaining agreement, the parties intend that the Employer should notify an employee that the employee may have a Union representative present when the employee is being interviewed for suspected misconduct. If the Employer fails to so advise an employee, the parties do not intend that this fact, in and of itself, will preclude discipline from being imposed on employee, or will prohibit the use of information gathered at the interview. However, if an employee’s Xxxxxxxxxx rights are violated, this Statement of Intent does not affect whether the Xxxxxxxxxx violation precludes discipline from being imposed on the employee or prohibits the use of information gathered at the interview.
