Right to refuse to work overtime. An Employee may refuse to work in excess of his or her ordinary rostered hours in circumstances where to do so would be unreasonable having regards to: • any risk to the Employee’s health and safety; • the Employee’s personal circumstances, including any family responsibilities; • the operational requirements of the workplace; • the length of notice given by UCMH of the requirement that the Employee work the additional hours and by the Employee of his or her intention to refuse to do so; • the hours previously required to be worked by the Employee; • whether any additional hours are on a public holiday; and • any other relevant matter.
