Right to Refuse Unsafe Work. Employees have the right to refuse to perform unsafe work pursuant to the Occupational Health and Safety Regulations of the Workers Compensation Act.

Right to Refuse Unsafe Work. The Company and the Union agree to cooperate in developing and maintaining a strong sense of safety awareness among employees and supervisors. It is, therefore, recognized that every employee has the right to refuse work if he has reasonable cause to believe that to perform the work would create undue hazard to the health or safety of any person. For the purpose of this section, all rules, procedures and outcomes will be as outlined in Section 3.12 of WorkSafe BC Occupational Health and Safety Regulation which are as follows:
Right to Refuse Unsafe Work. (a) No employee shall carry out or cause to be carried out any work process or operate or cause to be operated any tool, appliance or equipment when that employee has reasonable cause to believe that to do so would create an undue hazard to the health or safety of any person.
Right to Refuse Unsafe Work. An employee has the right to refuse hazardous work that may harm the employee or any other person in the workplace. When a worker exercises his or her right to refuse, he or she shall notify the Supervisor who shall promptly notify the Employee Advocate who shall participate in all stages of the investigation. The worker shall stand by at a safe place and participate fully in the investigation of the hazard. The Company shall ensure that no other worker is asked or permitted to perform the work of the worker who refused unless the second worker is advised of the reasons for the work refusal in the presence of the Employee Advocate. If the Union and the Company cannot agree on a remedy to the work refusal, the government inspector shall be called in. No employee shall be discharged, penalized, coerced, intimidated or disciplined by the Company for acting in compliance with the Occupational Health and Safety Act. There shall be no loss of pay, seniority or benefits for any employee who is impacted by a refusal to work in compliance with Occupational Health and Safety Act. The Company agrees that the Union certified members of the Joint Health and Safety Committee have the right to investigate dangerous circumstances at the workplace.
Right to Refuse Unsafe Work. (a) Notwithstanding the provisions of section 3.12 of the Occupational Health and Safety Regulation, a worker may refuse to perform any work activity which they have reason to believe is likely to endanger someone.
Right to Refuse Unsafe Work. An employee may refuse to perform work she considers to be unsafe. Such employee must immediately report the unsafe condition to her supervisor. The supervisor shall call in two members (one of whom will be a CUPE member) of the campus Health and Safety Committee to review and decide on the safety of the situation and any corrections required. The employee shall not lose pay, benefits or seniority, or be faced with any disciplinary action for refusing to perform duties which are considered to be unsafe or hazardous until corrected or reviewed. The College shall not assign any other employees to perform the work assignment in dispute.
