Recovery of Expenses. In any adversarial proceedings between the parties arising out of this agreement or the transactions it contemplates, the prevailing party will be entitled to recover from the other party, in addition to any other relief awarded, all expenses that the prevailing party incurs, including legal fees and expenses.
Recovery of Expenses. Any expenses incurred by the Company due to the fault of the Apprentice shall be recovered from the Apprentice.

For purposes of this section 24.5, “prevailing party” means, for any proceeding, the party in whose favor an award is rendered, except that if in those proceedings the award finds in favor of one party on one or more claims or counterclaims and in favor of the other party on one or more other claims or counterclaims, neither party will be the prevailing party. If any proceedings are voluntarily dismissed or are dismissed as part of settlement of that dispute, neither party will be the prevailing party in those proceedings.
Recovery of Expenses. Except as provided in Section 7 with respect to alternative dispute resolution, if a dispute arises with respect to this Agreement, the prevailing party shall be entitled to recover all expenses, including, without limitation, reasonable attorneys' fees and expenses, incurred in ascertaining that party's rights, in preparing to enforce, or in enforcing that party's rights under this Agreement, whether or not it was necessary for that party to institute suit.
Recovery of Expenses. Employer agrees to pay the reasonable and documented fees and expenses of one attorney to represent Executive along with the other eight executives executing the employment agreements on the Effective Date under the Plan. Such expenses may accrue prior to, but shall be paid only after, the Effective Date of the Plan.
Recovery of Expenses. 12.1 Where the employee has incurred costs to enable the employee to perform their job role in response to the impact of COVID-19, the University will reimburse the employee the full amount of the costs. This does not apply where the costs are unreasonable, unrelated to performing the employee’s job or would have been incurred by the employee regardless of their role with the University.
Recovery of Expenses. 4.11.1. The recovery of expenses under the Agreement is performed by Rostelecom only upon the presentation by the Operator to Rostelecom of the originals of the basic documents confirming such expenses.
Recovery of Expenses. The prevailing party in any proceeding arising from this Agreement will be entitled to reasonable attorneys’ fees, costs, and the expenses of litigation from the non-prevailing party.
Recovery of Expenses. Royalties shall be used first to offset out-of-pocket expenses incurred by the University in applying for, obtaining, and defending a patent and in developing and negotiating license agreements during the life of the patent. Expenses for this purpose will include fees paid be outside legal, consulting, and licensing organizations and any other out-of-pocket costs incurred by the University. The fees paid to the external individuals or organizations for such services may be of fixed dollar amount or may be in the form of an agreed-upon fraction or the gross royalty income, if any, or in any other form directly associated with commercialization/licensing of the invention. In addition, 10% or Royalties, after reduction as provided above for out-of-pocket expenses, received in any year from an invention made on or after April 11, 1992 shall be retained by the University and applied toward the general support of the Office or Cooperative Research; provided, that if the total or such recoveries in any year exceeds the Office’s approved budget, the excess shall be allocated in a pro rata basis among those inventions from which it was recovered and shall be distributed as part of Net Royalties in accordance with subparagraph (d).
Recovery of Expenses. If such repayment is not voluntarily made before the issuance of the unit member's final paycheck, the Employer may unilaterally recoup such expenses from any monetary payment due and owing the member and sue for any remaining amount.
