Records of Operation. The Operator shall keep adequate records, books of account and memoranda of the transactions involving the Facility, including, without limitation, the provision of Operating Inputs, Support Items, Support Services, AccessEntrance Rights, the construction of Modifications and the operations and maintenance of the Facility, including, without limitation, operation and maintenance programs, treatment and disposal of Waste Water and Biosolids, any records required by Section 6(e) of the Lease and other records in accordance with Prudent Industry Practice or as required by Governmental Authorities. All records shall be readily available for inspection and/or audit by the Trust, the Owner Participant and the User and their respective representatives at the Operator’s offices, during regular business hours and upon reasonable notice, and copies thereof shall be furnished to the Trust and the User upon request. In addition, the Trust shall have the right to provide such records to any proposed sublessee or transferee of the Trust.

Records of Operation. 6.2 Plant Appearance
Records of Operation. UW shall maintain complete and accurate records regarding the Treatment Facilities which includes records pertaining to all tasks relative to administration and implementation of the City’s IPP and ISP in accordance with Permit and Regulatory Requirements. These records shall be available for inspection by the City, during normal working hours. When the contract terminates these records shall become the property of the City.
Records of Operation. 6.1 LICENSEE will keep detailed and accurate records of the character and amount of charge and products and operating conditions and catalysts used in the Unit, and will keep such records as are necessary to determine royalties payable hereunder, and will furnish copies thereof to UOP at UOP's request. The amount of charge and products shall be determined by accurate tank gauges or other methods of measurement approved by UOP. UOP may, on reasonable notice and during business hours, make such examinations as it may deem necessary to verify such records.

  • CONTINUITY OF OPERATION Section 1: No Strikes, Work Stoppages or Lockouts Neither of the parties shall utilize any economic sanction to force its position on the other party over any issue. Further, no Employee or group of Employees shall individually or through concerted action, take part in any activity that impedes the operation of the business, except as otherwise authorized by this Agreement. Should any person or group of people participate in any such unauthorized activity, upon notification of such occurrence, the Union or the Company, as the case may be, will direct such person or group of people to resume normal operations and will take effective means to cease the unauthorized conduct. Any employee or group of employees who participate in such unauthorized activity shall be subject to immediate dismissal, unless mitigating circumstances exist that are acceptable to the ERRC. Should either party suffer financial damage as a result of such unauthorized activity, they may pursue compensation for such loss at the arbitration step of the Concern Resolution Process, and the arbitrator shall have full authority to remedy any violation of this Article.

  • Cessation of Operations Any cessation of operations by Borrower or Borrower admits it is otherwise generally unable to pay its debts as such debts become due, provided, however, that any disclosure of the Borrower’s ability to continue as a “going concern” shall not be an admission that the Borrower cannot pay its debts as they become due.
