Record Drawings and Annotated Specifications. The CONTRACTOR will prepare and maintain on a current basis an accurate and complete set of Record Drawings showing clearly all changes, revisions, and substitutions during construction, including, without limitation, field changes and the final location of all mechanical equipment, utility lines, ducts, outlets, structural members, walls, partitions, and other significant features, and Annotated Specifications showing clearly all changes, revisions, and substitutions during construction. A copy of such Record Drawings and Annotated Specifications will be delivered to DISTRICT in accordance with the schedule prepared by CONTRACTOR. In the event of a specification that allows CONTRACTOR to elect one of several brands, makes, or types of material or equipment, the annotations shall show which of the allowable items the CONTRACTOR has furnished. The CONTRACTOR will update the Record Drawings and Annotated Specifications as often as necessary to keep them current but no less often than weekly. The Record Drawings and Annotated Specifications shall be kept at the Site and available for inspection by the DISTRICT, Inspector of Record, and the ARCHITECT. On completion of the CONTRACTOR’s portion of the Work and prior to Application for Final Payment, the CONTRACTOR will provide one (1) complete paper set and one (1) electronic copy of Record Drawings and Annotated Specifications to the DISTRICT, certifying them to be a complete and accurate reflection of the actual construction conditions of the Work.

A copy of such Record Drawings and Annotated Specifications will be delivered to District in accordance with the Schedule prepared by Contractor. On completion of the Contractor’s portion of the Work and prior to Application for Final Payment, the Contractor will provide one complete set of Record Drawings and Annotated Specifications to the District, certifying them to be a complete and accurate reflection of the actual construction conditions of the Work. The Contractor must update the record drawings as work progresses. At the end of each month the Architect, and project inspector shall, review the record drawings. If the records are incomplete, or incorrect, an appropriate amount of dollars, equivalent to the cost of uncovering the work to determine the locations of piping and the like, may be deducted from the next progress payment. The deducted sum will be withheld until the record drawings are updated and/or corrected.

Neither the Contractor nor any Subcontractor or material or equipment supplier shall own or claim a copyright in such drawings, Specifications, and other similar or related documents; Owner shall retain all common law, statutory, and other intellectual property rights with respect thereto. The Contractor must deliver remaining copies of such documents to the Owner upon request or upon completion of the Work, except that the Contractor may keep one copy of such documents for its files. The Contractor shall only use such drawings, Specifications and other documents for this Project. Neither the Contractor nor any Subcontractor or material or equipment supplier may use such drawings, Specifications, and other documents on other projects without the specific written consent of the Owner. All models are the property of the Owner.
