Payment Upon Death of Employee. In the event of the death of Employee, any unpaid payments due either prior to Employee’s death or after Employee’s death in accordance with the terms of this Agreement shall be payable as designated by Employee prior to his death in writing to Employer. In the event of the death of all such persons so designated by Employee, either prior to the death of the Employee or during any time when payments are due as provided herein, or in the event Employee fails to so designate prior to his death, or withdraws all such designations, said payments thereafter shall be made to Employee’s estate.

If an employee who is entitled to any amount of long service leave dies before taking that amount of long service leave; or after commencing but before completing the taking of that amount of long service leave, ICC shall pay to that employee’s personal representative a sum equal to payment for the period of the amount of long service leave not taken or, as the case may be, the taking of which has not been completed by that employee.
Payment Upon Death of Employee. Any employee who dies prior to severing employment and who would otherwise have been entitled to such payment will be deemed to have severed employment the day preceding his/her death. Any payment that the deceased employee would have received for accumulated sick leave under Section C above will be paid to the employee's surviving spouse and/or estate in the manner provided by law.
