NOTICES OR OTHER COMMUNICATIONS. Confidential Information, notices and communications under this Agreement shall be transmitted to the representatives listed below. Any change of representative shall be made only upon written notice to the other party.
NOTICES OR OTHER COMMUNICATIONS. 9.18.1 How we may give notices. Where the mortgage requires or allows us to give a notice in writing to any person (including you) or to communicate in any other way in writing with any person (including you), we may give the notice or communication in any of the following ways. We may deliver it personally to the person. If the person is a corporation or partnership, we may deliver it personally to anyone we reasonably believe to be a director, officer, general partner or responsible employee or agent of the corporation or partnership. We may leave it at the person’s address last known to us with a grown- up person there or in a place where it should reasonably be seen by anyone at that address. We may mail it by prepaid mail addressed to the person at the person’s mailing address last known to us, and we may choose whether to send it by ordinary, certified or registered mail. Every party to the mortgage consents to our providing it in an electronic form (including fax) to any person or, if the person is a corporation or partnership, to a director or other person described above. We may advertise it in a newspaper published or generally read in the area where any part of the real estate is situated.
NOTICES OR OTHER COMMUNICATIONS. Except as otherwise specified in this Agreement, any notice or other communication required to be given pursuant to this Agreement shall be given in writing (including telecopier, telegraphic, telex or cable communication) or mailed (by first-class mail, postage prepaid) to the parties at the addresses set forth below. All such notices and communications shall, when mailed (by first-class mail, postage prepaid), telecopied, telegraphed, telexed, cabled, or faxed be effective when deposited in the mails, telecopied, sent by the telegraph company, confirmed by telex answerback, delivered to the cable company, or confirmed received in the case of a telecopy or facsimile, respectively. Alternatively, all such notices and communications shall be deemed effective when personally delivered to the party at its address below.

Any payment, notice or other communication required or permitted to be made or to be given to either party under this Agreement shall be sufficiently made or given three business days after the date of mailing if sent to such party by certified first class U.S. mail, postage prepaid, the date of transmission (or the next business day thereafter if such date is not a business day) by telecopier (to the respective numbers set forth below) with answer back to confirm or upon receipt if personally delivered (including by reputable overnight carrier) at the address as shall be designated by written notice given to the other party. Any notice or demand by Great-West to or upon the Group Contractholder, any GLWB Elector, Covered Person, or any other person, if applicable, may be given by mailing it to that person’s last known address as stated in Great-West’s file through the United States Postal Service or last known email address or facsimile number on file. An application, report, Request, election, direction, notice or demand by the Group Contractholder, any GLWB Elector, or other Covered Person(s), if applicable, will be made in a form satisfactory to Great-West. When Great-West requires it, the Group Contractholder will obtain the signature of the GLWB Elector on forms provided by Great-West. Great-West must first approve any written materials developed by any other person describing this Group Contract.

Any notice or demand by Great-West to or upon an Owner, Covered Person or other person, may be given by sending it to such person’s last known address, email address, or facsimile number on file with Great-West, or by posting it to an electronic network or website so long as a separate email notice is sent to the email address on file with Great-West. An application, report, request, election, direction, notice or demand by an Owner or any Covered Person(s), if applicable, must be made in Good Order.

GWL&A of NY may provide any notice or demand to Plan Sponsor, Contractholder, GLWB Participant, Covered Person, Beneficiary, Alternate Payee, or other person by either sending it to such person’s last known address, email address, or facsimile number on file with GWL&A of NY, or by posting it to an electronic network or website so long as a separate email notice is sent to the email address on file with GWL&A of NY. An application, report, request, election, direction, notice or demand by a Contractholder, any GLWB Participant or other Covered Person(s), if applicable, must be made in Good Order. When GWL&A of NY requires it, Plan Sponsor will obtain the signature of the Payee on forms provided by GWL&A of NY. GWL&A of NY must first approve any written materials describing the Contract that are developed by any other person.
