MOLD AND MOISTURE. Owner acknowledges and agrees that IFS is not responsible or liable for any losses or damages (of any kind or nature) incurred or suffered by Owner that are caused by, relate to or arise out of rust, rot, microbial contamination, mold, bacteria, fungi or water.

MOLD AND MOISTURE. It is generally understood that mold spores are present essentially everywhere and that mold can grow in most any moist location. Emphasis is properly placed on prevention of moisture and on good housekeeping and ventilation practices. Tenant acknowledges the necessity of housekeeping, ventilation, and moisture control (especially in kitchens, janitor's closets, bathrooms, break rooms and around outside walls) for mold prevention. In signing this Amendment, Tenant has not observed mold, mildew or moisture within the Reduced Premises; however, Tenant has not hired any inspector to confirm/deny such claim, nor has Tenant investigated behind any of the walls in the Reduced Premises or the Building. Tenant agrees to promptly notify Landlord if Tenant observes mold/mildew and/or moisture conditions (from any source, including leaks), and allow Landlord to evaluate and make recommendations and/or take appropriate corrective action at Landlord's cost unless otherwise set forth in the Lease. Tenant releases Landlord from any liability for any personal injury or damages to property caused by or associated with moisture or the growth of or occurrence of mold or mildew on the Reduced Premises or the Building of which Tenant knew and failed to notify Landlord in accordance with this Section 11. In addition, execution of this Amendment constitutes acknowledgement by Tenant that control of moisture and mold prevention are integral to its obligations under the Lease as modified by this Amendment; provided, however, that Landlord, at its sole cost and expense, shall be responsible for remediation of any mold or mildew in the Building, for fixing leaks in the Building, for providing proper ventilation to the Building to prevent moisture accumulation, and for causing its cleaning service provider to diligently mop up or otherwise remove any mold, mildew or moisture that such provider encounters in its daily cleaning of the Reduced Premises.

Tenant agrees to immediately notify Landlord if Tenant observes mold/mildew and/or moisture conditions (from any source, including leaks), and allow Landlord to evaluate and make recommendations and/or take appropriate corrective action. Tenant releases Landlord from any liability for any personal injury or damages to property caused by or associated with moisture or the growth of or occurrence of mold or mildew on the Premises and in the Building. In addition, execution of this Lease constitutes acknowledgement by Tenant that control of moisture and mold prevention are integral to its obligations under this Lease.
MOLD AND MOISTURE. Mold commonly occurs in the environment and in homes and is an abundant and essential part of the world’s ecological system. Molds are classified as fungi and are found nearly everywhere. The majority of mold types are not toxic. To date, the health effects of mold are not known with any certainty. The only agreement seems to be that responses to mold are individualized, based on each person’s immune system. It is not uncommon for mold to develop on framing members during construction.

  • MOLD AND MILDEW Resident acknowledges that it is necessary for Resident to provide appropriate climate control, keep the Apartment clean, and take other measures to retard and prevent mold and mildew from accumulating in the Apartment. Resident agrees to clean and dust the Apartment on a regular basis and to remove visible moisture accumulation on windows, walls and other surfaces as soon as reasonably possible. Resident further agrees not to block or cover any of the heating, ventilation or air-conditioning ducts in the Unit. Resident agrees to immediately report to the management office: (i) any evidence of a water leak or excessive moisture in the Apartment, as well as in any storage room, garage or other common area; (ii) any evidence of mold- or mildew-like growth that cannot be removed by simply applying a common household cleaner and wiping the area; (iii) any failure or malfunction in the heating, ventilation, air conditioning systems or laundry systems in the Apartment; and (iv) any inoperable doors or windows. Resident further agrees that Resident shall be responsible for damage to the Premises and Resident’s property as well as injury to Resident, Authorized Occupants, Resident’s family member(s), and guests resulting from Resident’s failure to comply with the terms of this Section.

  • Mold The Resident acknowledges that to avoid mold growth it is important to prevent excessive moisture buildup and agrees to remove visible moisture accumulation as soon as it occurs and immediately report to Owner any evidence of excess moisture or mold or mildew inside the Home. Resident acknowledges receipt of the “Mold Information and Prevention Addendum” which is fully executed and incorporated herein by reference.

  • Substance Abuse Testing The Parties agree that it is in the best interest of all concerned to promote a safe working environment. The Union has no objection to pre-employment substance abuse testing when required by the Employer and further, the Union has no objection to voluntary substance abuse testing to qualify for employment on projects when required by a project owner. The cost and scheduling of such testing shall be paid for and arranged by the Employer. The Union agrees to reimburse the Employer for any failed pre-access Alcohol and Drug test costs.

  • Contamination The presence in, on or under land, air or water of a substance (whether a solid, liquid, gas, odour, heat, sound, vibration or radiation) at a concentration above the concentration at which the substance is normally present in, on or under land, air or water in the same locality, that presents a risk of Environmental Harm, including harm to human health or any other aspect of the Environment, or could otherwise give rise to a risk of non-compliance with any Statutory Requirement for the protection of the Environment.

  • Data Loss Prevention Transfer Agent shall implement a data leakage program that is designed to identify, detect, monitor and document Fund Data leaving Transfer Agent’s control without authorization in place.

  • COUNTERFEIT WORK (a) The following definitions apply to this clause:

  • SUBSTANCE ABUSE The dangers and costs that alcohol and other chemical abuses can create in the electrical contracting industry in terms of safety and productivity are significant. The parties to this Agreement resolve to combat chemical abuse in any form and agree that, to be effective, programs to eliminate substance abuse and impairment should contain a strong rehabilitation component. The local parties recognize that the implementation of a drug and alcohol policy and program must be subject to all applicable federal, state, and local laws and regulations. Such policies and programs must also be administered in accordance with accepted scientific principles, and must incorporate procedural safeguards to ensure fairness in application and protection of legitimate interests of privacy and confidentiality. To provide a drug-free workforce for the Electrical Construction Industry, each IBEW local union and NECA chapter shall implement an area-wide Substance Abuse Testing Policy. The policy shall include minimum standards as required by the IBEW and NECA. Should any of the required minimum standards fail to comply with federal, state, and/or local laws and regulations, they shall be modified by the local union and chapter to meet the requirements of those laws and regulations.
