Mandatory Connection. All property owners included within the Project, wherein dwellings are located, shall be required to connect to the System pursuant to the provisions of the Ordinance and this Agreement, if the property has a failed or failing sanitary sewer system. If a property owner is not required to connect to the System, whether they be an owner of vacant property or do not have a failed or failing system, or otherwise, the property owner shall be responsible for the costs of construction and installation of the System, which is reflected in the assessment, as determined by the Township and shall be subject to the same lien provisions as set forth in this Agreement. In accordance with the Ordinance, all properties included within the Project, wherein dwellings are located, shall be required to have said dwellings connected to the System prior to any sale or transfer of said dwelling to another person or entity, unless the property owner of said dwelling provides a written statement and/or certification from the Bucks County Board of Health, or a certification from a third party, whose certification is accepted by the Bucks County Board of Health, that the sanitary sewer system located on the tax parcel is not a failing or marginal on-site sewage disposal system.

Mandatory Connection. Pursuant to Section 381.0065(2)(a), Florida Statutes (as amended), Laws of Florida Chapter 99-395(4), the Village’s home rule powers, and as set forth in Section 62-1(d) of the Village’s Code of Ordinances, mandatory connection to the Wastewater System is required.

  • NYISO and Connecting Transmission Owner Obligations Connecting Transmission Owner and NYISO shall cause the New York State Transmission System and the Connecting Transmission Owner’s Attachment Facilities to be operated, maintained and controlled in a safe and reliable manner in accordance with this Agreement and the NYISO Tariffs. Connecting Transmission Owner and NYISO may provide operating instructions to Developer consistent with this Agreement, NYISO procedures and Connecting Transmission Owner’s operating protocols and procedures as they may change from time to time. Connecting Transmission Owner and NYISO will consider changes to their respective operating protocols and procedures proposed by Developer.

  • Connections HTC”s responsibility for service ends at the demarcation point. “Demarcation” means the point of meeting where the “hand-off” occurs between HTC’s system and Customer’s system. Facilities used by HTC in providing Services may be connected with terminal equipment or communications systems provided by Customer. In such a case, facilities and terminal equipment or communications systems provided by Customer or its customers shall be subject to mutually agreeable technical interface specifications.

  • Internet Connection In order to ensure the proper functioning of the Production Monitor and the Consumption Monitor, if possible, you must provide the Solar System with continuous access to a functioning broadband internet connection with one (1) wired Ethernet port and standard electrical outlet, at your cost. If you are unable to provide the Solar System with an internet connection in accordance with the foregoing sentence, the Home must be located in an area with cellular service that is acceptable to us in our discretion.

  • Connecting Transmission Owner Obligations Connecting Transmission Owner shall maintain its transmission facilities and Attachment Facilities in a safe and reliable manner and in accordance with this Agreement.

  • Reconnection The Parties shall cooperate with each other to restore the Small Generating Facility, Interconnection Facilities, and the New York State Transmission System and Distribution System to their normal operating state as soon as reasonably practicable following a temporary disconnection.

  • Nyiso and Connecting Transmission Owner Authority General.‌‌ NYISO or Connecting Transmission Owner may take whatever actions with regard to the New York State Transmission System or the Connecting Transmission Owner’s Attachment Facilities it deems necessary during an Emergency State in order to (i) preserve public health and safety, (ii) preserve the reliability of the New York State Transmission System or the Connecting Transmission Owner’s Attachment Facilities, (iii) limit or prevent damage, and (iv) expedite restoration of service. NYISO and Connecting Transmission Owner shall use Reasonable Efforts to minimize the effect of such actions or inactions on the Large Generating Facility or the Developer’s Attachment Facilities. NYISO or Connecting Transmission Owner may, on the basis of technical considerations, require the Large Generating Facility to mitigate an Emergency State by taking actions necessary and limited in scope to remedy the Emergency State, including, but not limited to, directing Developer to shut-down, start-up, increase or decrease the real or reactive power output of the Large Generating Facility; implementing a reduction or disconnection pursuant to Article 13.4.2; directing the Developer to assist with blackstart (if available) or restoration efforts; or altering the outage schedules of the Large Generating Facility and the Developer’s Attachment Facilities. Developer shall comply with all of the NYISO and Connecting Transmission Owner’s operating instructions concerning Large Generating Facility real power and reactive power output within the manufacturer’s design limitations of the Large Generating Facility’s equipment that is in service and physically available for operation at the time, in compliance with Applicable Laws and Regulations.

  • Trunk Group Connections and Ordering 5.2.1 For both One-Way and Two-Way Interconnection Trunks, if Onvoy wishes to use a technically feasible interface other than a DS1 or a DS3 facility at the POI, the Parties shall negotiate reasonable terms and conditions (including, without limitation, rates and implementation timeframes) for such arrangement; and, if the Parties cannot agree to such terms and conditions (including, without limitation, rates and implementation timeframes), either Party may utilize the Agreement’s dispute resolution procedures.

  • Indirect Network Connection 64.8.1 For purposes of this Agreement, Indirect Traffic means traffic which is originated by one Party and terminated to the other Party in which a third party ILEC’s Tandem switch both provides the intermediary Transit Service and serves CenturyLink’s NXXs. Indirect Network Connection for Indirect Traffic is intended only for de minimis traffic associated with CLEC “start- up” market entry into a CenturyLink local exchange. Therefore Indirect Network Connection will be allowed only on routes between CenturyLink End Offices and a CLEC switch in instances where, and only so long as, none of the POI thresholds set forth in Section 64.4.2 have been reached.
