Common use of Jury and Witness Leave Clause in Contracts

Jury and Witness Leave. ‌ A faculty member who is under a proper summons as a juror or subpoenaed to serve as a witness shall, in accordance with Mont. Code Xxx. § 2-18-619, collect all fees payable as a result of the service and forward the fees to the appropriate accounting office. However, a faculty member shall not be required to remit to the Employer any expense or mileage allowance paid to him/her by the court. Such fees shall be applied against the amount due the faculty member from the Employer. However, if a faculty member elects to charge the time off against leave without pay, the faculty member shall not be required to remit fees to the Employer.
