Inventory Obsolescence. To the Company's Knowledge, the Flextronics components described on Schedule 1.3 that the Company has committed prior to the date hereof to purchase from Flextronics(the components committed to be purchased by the Company to the extent set forth on Schedule 1.3, the “Flex Components”) are consumable in the normal course of business, and in any event, within eighteen (18) months following the Effective Date.
Inventory Obsolescence. In the event and to the extent that Products or Sales Aids in the possession of NSJ shall, due to the expiration, change in market conditions, or other reasons not within the control of NSJ, become nonsaleable, NSHK agreed to credit the original purchase price of such Products or Sales Aids to NSJ. The ultimate cost and method of disposal of any such Products and Sales Aids shall be the reseponsibility of NSHK.

  • Inventory To the extent Inventory held for sale or lease has been produced by any Borrower, it has been and will be produced by such Borrower in accordance with the Federal Fair Labor Standards Act of 1938, as amended, and all rules, regulations and orders thereunder.
