Equipment Manager. Immediately upon termination of the Interim Period, Executive shall assume a role with U.S. Concrete as the Equipment Manager (the “Equipment Manager Period”). The Equipment Manager Period shall terminate on the twelve (12) month anniversary of the termination of the Interim Period; provided, however, upon the mutual written agreement of U.S. Concrete and Executive, the Equipment Manager Period may be extended for periods up to twelve (12) months. During the Equipment Manager Period, Executive’s Monthly Base Salary, position and principal place of employment will change as set forth on Schedule 1 hereto, and his authority, duties and responsibilities will be to support U.S. Concrete’s Chief Executive Officer on a national basis with respect to managing equipment, capital expenditure matters, maintenance and TMT development and environmental programs (collectively, the “Equipment Manager Changes”). U.S. Concrete and Executive mutually agree that the Equipment Manager Changes shall not constitute “Good Cause” for termination by Executive pursuant to Section 1.2.a. of the Agreement.

Equipment Manager. Due to the geographic location of the Bus Radio Equipment, the capabilities of the in-house Dallas ISD Radio Shop, and in order to maintain security and consistency in the management of the Bus Radio Equipment, the Parties hereto agree that the Dallas Independent School District is in the best position to serve as the manager of the Bus Radio Equipment (“Equipment Manager”) during the term of this Agreement. Dallas Independent School District hereby agrees to accept the assignment of the License and agrees serve as Equipment Manager to coordinate service and repairs to the Bus Radio Equipment as described herein. The Equipment Manager shall hold the three (3) emergency frequencies and associated repeaters and hardware in reserve for the benefit of all Parties as needed.

Equipment Manager. The Equipment Manager is a voting member of the Board of Directors who responds to the Vice-President and who is primarily responsible for the procurement, preparation, issue, maintenance, replacement, and accountability of all baseball and softball equipment and supplies. The Equipment Coordinator sorts, repairs or has repaired, and inventories Local League equipment stocks to identify additional equipment and supply needs; obtains written cost estimates, solicits competitive bids, and gains approval from the board for the allocation of funds to purchase the equipment and supplies needed; issues said equipment and supplies, replaces said equipment and supplies as necessary; and at the end of the year, collects, accounts for, maintains, and stores said equipment and supplies for the next year.
