Competitive Bids. Upon receipt of a request by the Borrower for a Competitive Loan, each Lender may, in its sole discretion, submit a Competitive Bid containing an offer to make a Competitive Loan in an amount up to the amount specified in the related request for Competitive Loans. Such Competitive Bid shall be submitted to the Borrower by telephone notice (to be immediately confirmed by telecopy) by such time as determined by such Lender in accordance with such Lender's customary practices (in any event not to be later than 10:30 A.M. (Charlotte, North Carolina time)) on the date of the requested Competitive Loan. Competitive Bids so made shall be irrevocable. Each Competitive Bid shall specify (i) the date of the proposed Competitive Loan, (ii) the maximum and minimum principal amounts of the Competitive Loan for which such offer is being made (which may be for all or a part of (but not more than) the amount requested by the Borrower), (iii) the applicable Competitive Bid Rate, and (iv) the applicable Interest Period.
Competitive Bids. (i) Each Revolving Credit Lender may, in its sole discretion, make up to three (3) Competitive Bids to the Borrower in response to a Competitive Bid Request. Each Competitive Bid by a Revolving Credit Lender must be received by the Administrative Agent via facsimile, in the form of Exhibit A-7 hereto, (A) not later than 10:30 a.m. three (3) Business Days before any proposed Eurodollar Competitive Bid Loan and (B) not later than 10:30 a.m. on the same Business Day as a proposed Fixed Rate Loan, and any Competitive Bid received by the Administrative Agent after such time can be rejected by the Administrative Agent. Competitive Bids that do not conform substantially to the form of Exhibit A-7 or otherwise include additional conditions to funding shall be rejected by the Administrative Agent and the Administrative Agent shall notify the Revolving Credit Lender making such nonconforming bid of such rejection as soon as practicable. Each Competitive Bid shall refer to this Agreement and specify (A) the principal amount of the Competitive Bid Loan or Loans that the Revolving Credit Lender is willing to make to the Borrower which shall be in a minimum principal amount of $1,000,000 or a whole multiple of $1,000,000 in excess thereof and may equal the entire principal amount of the Competitive Bid Loan requested by the Borrower, (B) the Competitive Bid Rate or Rates at which the Revolving Credit Lender is prepared to make the Competitive Bid Loan or Loans and (C) the Competitive Bid Interest Period with respect thereto. A Competitive Bid submitted by a Revolving Credit Lender pursuant to this Section 2.04(b)(i) shall be irrevocable.
Competitive Bids. With the exception of services or products obtained for use in a leveraged environment, the Contractor agrees competitive bidding will be utilized for all purchases in direct and exclusive support of RIDOH which are made under this Agreement in excess of five thousand dollars ($5,000) or an aggregate of five thousand dollars ($5,000) for any like items during the time of performance of this Agreement. Evidence of competitive bids must be retained in accordance with PAR. 20. - ACCESSIBILITY AND RETENTION OF RECORDS.
Competitive Bids. Each Bank may in its sole and absolute discretion make one or more Competitive Bids to the Company in response to a Competitive Bid Request. Each Competitive Bid by a Bank must be substantially in the form of EXHIBIT G and must be received by the Agent by facsimile not later than 11:30 a.m., New York City time, on the proposed Borrowing Date of such Competitive Bid Borrowing. Competitive Bids that do not conform substantially to the form of EXHIBIT G may be rejected by the Agent, and the Agent shall notify the applicable Bank as promptly as practicable. Each Competitive Bid shall specify (i) the principal amount (which shall be the amount of $5,000,000 or in integral multiples of $1,000,000 in excess thereof and which may equal the entire principal amount of the Competitive Bid Borrowing requested by the Company) of the Competitive Bid Loan or Loans that the Bank is willing to make, (ii) the rate of interest (the "Competitive Bid Rate") at which the Bank is prepared to make such Loan (expressed as a percentage rate per annum in the form of a decimal to no more than four decimal places) and (iii) the term applicable to each such Competitive Bid Loan and the date of maturity of such Competitive Bid Loan.
Competitive Bids. (i) Each Lender may, but shall have no obligation to, submit one or more Competitive Bids, each containing an irrevocable offer to make a Competitive Bid Loan in response to a Competitive Bid Request; provided, that if the Borrower’s Competitive Bid Request specified more than one Interest Period, such Lender may make a single submission containing a separate offer for each Interest Period and each such separate offer shall be deemed to be a separate Competitive Bid. Each Competitive Bid by a Lender must be received by the Borrower directly by telecopy not later than 11:30 a.m. (Atlanta, Georgia time) on the proposed date of Borrowing.
Competitive Bids. No Grant funds shall be disbursed to Grantee unless and until, with respect to contracts and/or purchases related to the Project exceeding $325,000, Grantee shall have obtained competitive bids using (a) Grantee’s established competitive bidding procedures (including, but not limited to, utilization of any continuing services agreements with approved vendors), a copy of which established procedures shall be uploaded to Triumph’s SmartSheet system, and/or (b) any statutory or regulatory procedures applicable to Grantee. In awarding contracts, Grantee shall award the contract to the lowest cost qualified responsive bidder considering the selection criteria contained within the invitation to bid. Triumph shall review the proposed award and all other contracts before the bid is awarded. Triumph shall have fifteen (15) days from the receipt of the submitted material to notify Grantee of its approval or disapproval of such proposed award or contract. If Triumph fails to approve or disapprove of the award or contract within such fifteen (15) day period, the award or contract shall be deemed approved.
Competitive Bids. Landlord shall seek at least 3 and no more than 5 competitive bids from general contractors selected by Tenant and approved by Landlord, which approval shall not be unreasonably withheld. However, only subcontractors from Landlord’s approved subcontractor list (which list shall include multiple names for each trade, excluding proprietary contractors) shall be allowed to work on the mechanical, electrical and plumbing components of the Office Building. Tenant shall be invited to the bid opening and allowed, but not required, to participate in the qualification of bids, opening of bids (if a sealed bid process is used), and the selection of the successful bidder; provided that Tenant shall make the final selection of the general contractor.
Competitive Bids. Nothing in this Policy is to be construed to require Augusta, Georgia to award a bid contract to other than the lowest responsible bidder, or to require contractors to award to subcontractors, or to make significant material purchases from local small businesses who do not submit the best overall pricing to Augusta, Georgia.
