Tenant’s liability insurance will (a) include Landlord, Property Manager and the other Landlord Parties as additional insureds with respect to all matters arising out of the occupancy or use of the Premises or Property by Tenant; (b) be primary to any other insurance maintained by the Landlord Parties; (c) be placed and maintained with companies rated at least “A/VII” by A.M. Best Insurance Service or otherwise reasonably satisfactory to Landlord, and (d) include contractual liability coverage.
All such documentation will list Tenant or its agent as the responsible party and will not attribute responsibility for any such Hazardous Materials to Landlord or Property Manager.
Such audit will take place during regular business hours at a time and place reasonably acceptable to Landlord (which may be the location where Landlord or Property Manager maintains the applicable records).
The Property Manager then serving is authorized to take actions and give notices and demands under this Lease on Landlord’s behalf.
