Emergency Safety Actions. 34 In an emergency affecting the safety of life or property, including adjoining property, the Entity, without 35 previous instructions or authorizations from the District, is authorized and shall act at its discretion and risk to 36 prevent such threatened loss or injury, and the Entity shall bear all costs of that action, unless such emergency 37 is cause by the District’s negligence or willful misconduct. The Entity shall immediately notify the District’s 38 Representative of such actions, and thereafter shall comply with any instructions issued by the District’s 39 Representative. 40 1 ARTICLE 11. Contractor shall immediately notify the District Representative of such actions, and thereafter shall comply with any instructions issued by the District Representative.
