Effect of a Force Majeure Event. Subject to clause 11.4, if a party is prevented from performing any obligations under this agreement by reason of a Force Majeure Event (Affected Party), then:
Effect of a Force Majeure Event. The Affected Party is excused from performance of its obligations under this Agreement to the extent that performance thereof is impeded or prevented due to a Force Majeure Event and shall not be liable for the non-performance of such obligation during the period of Force Majeure. The Affected Party shall however continue to perform all of its obligations under this Agreement, which are not affected by a Force Majeure Event in accordance with the terms of this Agreement. If a Prolonged Force Majeure Event occurs, which wholly or partially prevents performance by either Party, then the Affected Party may upon twenty (20) Business Days' notice to the other Party provided that such Prolonged Force Majeure Event is continuing, terminate this Agreement. In this event, the O&M Contractor shall no later than ten (10) Business Days of such notice being delivered comply with its obligations under Clauses 12.5(a) (O&M Contractor Obligations on Expiry or Termination) to 12.5(f).
Effect of a Force Majeure Event. Neither party shall be liable for its failure or delay in performance of its obligations under this Agreement if such failure or delay is caused by a Force Majeure Event. If a Force Majeure Event occurs and is continuing, then the non-affected party may terminate this Agreement without liability if the affected party is not able to resume its performance within sixty (60) days.

In the case of Other Force Majeure Event, the Term shall be automatically extended for a period equal to the duration of the Other Force Majeure Event. Notwithstanding the existence of any Force Majeure Event, the Affected Party shall however continue to perform all of its obligations under this Agreement, which are not affected by such Force Majeure Event in accordance with this Agreement.
