District Rights, Power and Authority. Except as limited by the specific and express terms of this Agreement, the District shall retain all of its powers and authority, and the use of judgment and discretion in connection therewith, to direct, manage and control to the full extent of the law. Included in but not limited to those duties and powers are the exclusive rights to: determine its organization, direct the work of its employees, determine times and hours of operations; determine the kinds and levels of service to be provided, and methods and objectives; insure the rights and educational opportunities of students; to establish educational policies, goals, and objectives; determine the staffing patterns, determine the number and kinds of personnel required, maintain the efficiency of the District operation; determine the curriculum; build, move or modify the facilities; develop and implement budget and budget procedures; determine the methods of raising revenue; contract out work; hire, classify, assign, transfer, evaluate, promote, terminate, and discipline employees; and take actions which the District deems appropriate to comply with the Americans With Disabilities Act.
