Disposition of Nonconforming Product. 20.1 When notified of material rejection claim by IMS Buhrke Industries/Xxxxx Metal Products, supplier is expected to acknowledge receipt of notification with 24 hours. A full response is required within 10 working days. If response is not received, the amount indicated will be debited to your account. Additionally, if no disposition is made after 30 days of notification, material will be scrapped
Disposition of Nonconforming Product. In any case where Nycomed expects to make a claim against POZEN with respect to damaged or otherwise nonconforming Product, Nycomed shall not dispose of such Product without written authorization and instructions of POZEN either to dispose of the Product or to return the Product to POZEN. If the Product is returned to POZEN, all risk of loss and/or damage to such Product shall pass to POZEN upon delivery of the Product to POZEN’s designated carrier at Nycomed’s designated facility.
Disposition of Nonconforming Product. In any case where RELYPSA expects to make a claim against PATHEON with respect to Non-Conforming Bulk or Finished Product (as applicable) that has been shipped to RELYPSA or its designee, RELYPSA shall [***]. PATHEON acknowledges that any Non-Conforming Bulk or Finished Product returned to PATHEON shall be destroyed by it in accordance with all Applicable Laws, and shall not be used in any manner or removed from the Patheon Facility. All costs associated with the shipment of Non-Conforming Bulk or Finished Product to the Patheon Facility and the disposition of such Bulk or Finished Product shall be borne solely by PATHEON if such Bulk or Finished Product is properly rejected by RELYPSA in accordance with this Section 8.1.

In any case where Immunex or Wyeth expects to make a claim against BIP with respect to damaged or otherwise nonconforming Bulk Drug Substance, Drug Product or Finished Product, Immunex and Wyeth shall not dispose of or allow to be disposed such Bulk Drug Substance, Drug Product or Finished Product, as the case may be, without written authorization and instructions of BIP either to dispose of or return to BIP such Bulk Drug Substance, Drug Product or Finished Product. Upon written request by Buyer, BIP agrees promptly to give the requesting Party such authorization and instructions within a reasonable period of time.

In any case where Discovery Labs expects to make a claim against DSM with respect to damaged or otherwise nonconforming Product, Discovery Labs shall not dispose of such Product without written authorization and instructions of DSM either to dispose of the Product or to return the Product to DSM.
