Supplying Party definition

Supplying Party shall have the meaning stated in Section 35.8.2.

Supplying Party has the meaning ascribed thereto in Section 5.4(2);

Supplying Party means a party to this Agreement that manufactures certain Membranes ordered by the other party pursuant to this Agreement and that sells such Membranes to the other party.

Examples of Supplying Party in a sentence

• Upon termination or expiration of this Agreement, a Party shall use reasonable efforts to destroy, erase, delete or return to the Supplying Party any and all written or electronic Confidential Information.

• The Supplying Party may also choose to waive compliance with the provisions of this Agreement.

• In no event shall a receiving Party retain copies of any Confidential Information provided by a Supplying Party.

• In addition to the equitable relief referred to in this section, a Supplying Party shall only be entitled to recover from a receiving Party any and all gains wrongfully acquired, directly or indirectly, from a receiving Party’s unauthorized disclosure of Confidential Information.

• All Confidential Information provided by the Supplying Party shall be returned by the receiving Party to the Supplying Party promptly upon request.

Supplying Party means the Party supplying a product or service to the other Party under any of the Alliance Agreements and the term "Procuring Party" means the Party procuring a product or service from the Supplying Party under any of the Alliance Agreements. The Parties will co-market and sell each others services, as identified and as specified in the CMA.
