Common use of Definition of a Layoff Clause in Contracts

Definition of a Layoff. β€Œ All layoffs shall be done in reverse order of seniority provided the employees remaining have the ability to properly perform the assigned duties. The Employer shall provide basic orientation and/or training to an employee if the employee requires it to perform the duties of the position, but in such case Article 12.4 will apply. It is understood that the Employer must show just reasons for any layoff that is not in reverse order of seniority.
