Defects Under Normal Use and Service. If a defect or malfunction occurs in any Product while it is under normal use and service, Customer shall promptly notify ES&S, and ES&S shall use reasonable efforts to restore the item to Normal Working Condition as soon as practicable. The services provided by ES&S pursuant to this Subsection 1(b)(i) are referred to herein as “Repair Services”. ES&S will perform Repair Services in conjunction with a Routine Maintenance Service Event at the Customer’s Designated Location or at ES&S’ designated depot location as may be determined by ES&S in its sole discretion. Repair Services at ES&S designated depot location will also include a complete Routine Maintenance Service Event. Customer shall be responsible for the payment of shipping cost to ES&S’ designated depot location and ES&S shall be responsible for the payment of shipping costs to return the Product(s) to Customer’s designated location. In addition, Customer shall be responsible for packaging and readying Product for return to ES&S by utilizing the original boxes and packing materials to return the Products to ES&S. In the event the Customer requires ES&S to provide new boxes and packing material for return of the Products, such items will be invoiced to Customer separately and shall be due and payable upon receipt of ES&S’ invoice by Customer.

Customer acknowledges that Product(s) identified on Schedule F1 as “depot repair only” may only be repaired at a Depot.

If a defect or malfunction occurs in any Product while it is under normal use and service, COUNTY shall promptly notify CONTRACTOR, and CONTRACTOR shall use reasonable efforts to restore the item to Normal Working Condition as soon as practicable. The services provided by CONTRACTOR pursuant to this Subsection 1(b)(i) are referred to herein as "Repair Services". CONTRACTOR will perform Repair Services in conjunction with a preventative maintenance event as follows: Repair Services for Products covered under this Agreement will be performed at COUNTY's Designated Location.

In regard to the AutoMARK Voter Assist Terminals, if a defect or malfunction occurs in any Product while it is under normal use and service, Customer shall promptly notify ES&S, and ES&S shall use reasonable efforts to restore the item to Normal Working Condition as soon as practicable. The services provided by ES&S pursuant to this Subsection 1(b)(i) are referred to herein as “Repair Services”. ES&S will perform Repair Services in conjunction with a preventative maintenance event at Customer’s Designated Location. Repair services performed outside of a preventative maintenance event shall be performed at an ES&S Depot Location and the Customer shall pay all costs associated with shipping Product(s) to the Depot, including insurance.

PES shall provide the Remedial Maintenance Services at its Depot; provided, however, that if Remedial Maintenance Services are required for 10 or more Products at any given time, Customer may elect to have such services provided at its Designated Location; provided, further, that all Remedial Maintenance Services provided for central count equipment shall be provided at Customer‟s Designated Location. Customer acknowledges that the Product(s) identified on Attachment 1 as “depot repair only” may only be repaired at a Depot. Customer shall pay all costs associated with shipping Hardware to a PES-designated Depot, including insurance. PES shall pay the return shipping costs, including insurance.

The services provided by Contractor pursuant to this Subsection 1(c)(i) are referred to herein as “Remedial Maintenance Services”. Contractor shall provide the Remedial Maintenance Services at its Depot; provided, however, that if Remedial Maintenance Services are required for ten (10) or more Products at any given time, State may elect to have them provided at its Designated Location; provided, further, that all Remedial Maintenance Services provided for central count equipment shall be provided at State’s Designated Location. State acknowledges that Product(s) identified on Schedule F1 as “depot repair only” may only be repaired at a Depot.
